Hi,

Can someone please tell me the procedure and wait time after returning required evidence to embassy for a K1 visa? My fiance had his interview on june 1st at the Haitian embassy and passed the interview but we only provided 4 pictures that were not as intimate according to the embassy so we provided what they requested.

My fiance was requested for more intimate pictures at the Haiti consulate. I was able to send him all of our pictures and he returned them to the embassy yesterday and was told they would contact him and not give him any additional details. I'm nervous and running out of patience. has any one ever gone to this process. please help!!!

It depends from one case to another and one consulate to another... There is one couple who was asked for additional evidence at the VN consulate and they submitted it 7 months ago... still waiting still no word... it could be days, weeks, or months...

Sorry I cannot tell you a timeline as ScottThuy mentioned. It depends on many factors.

Did they really ask for more "intimate" photos? What did they mean? Or were they just asking for more than 4 photos think you should have 20 or 30 photos?

I cannot believe they would ask for more intimate photos.

Perhaps showing PDAs (public displays of affection)?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I can understand it. Posed or group shots are good for the petition, but they don't tell a "love story" to the consular officer. It sounds like they want to see photos of them being a couple, and enjoying each other's company, and not so much posing at tourist attractions and landmarks.

The consular officers in HCMC have asked K1 beneficiaries deeply personal questions about their sex life with the petitioner. Asking for more intimate photos seems pretty tame by comparison.

Pics ARE important evidence. Don't let others tell you pics are only "secondary" evidence.

Good luck!

:star:

the embassy told my fiance the pictures we previously gave them is not suffient. we gave a total of 5 pictures and they handed them back after the interview and gave him a letter requesting more. He said the consulate told him the pictures did not show any evidence of relationship and needed to see more.

Alot of people refer to pictures as secondary evidence but I think they go along way. In my own opinion I think they are primary evidence and highly important. We had hundreds at the interview and the CO was more interested in them than all the other evidence we had. Actually I think he just enjoyed looking at them!

As far as intimate goes, well I had a few of us smooching (now mind you, I'm not talking about tongue down the throat action - just smooches  )

And I did send a few very dirty photos (believe it or not)

(Doan and I in the mud bath at Thap Ba Mineral Spa  )

I agree 100% about photos being extremely important. I do not agree with the classification of primary versus secondary evidence when it comes to showing evidence of an ongoing bona fide relationship [iMO].

But in my fiancee's country, a proper woman and man would never kiss in public. My fiancee would not tolerate it and I have studied the culture enough not to even ask. Those I do see kissing in public are either "paid dates" or young high school or university kids.

I think the Embassy in Thailand will understand the culture of its citizens and not expect to see public displays of affection. We have some photos with my arm around her waist. That is as far as it goes in public.

All southeast Asian countries are equally conservative when it comes to public displays of affection. However, even in southeast Asia it would not be unreasonable to expect a romantic couple to spend time together in intimate settings, and to have photos of these memorable occasions. Asians also have a passion for photos. If you put your camera down for more than 30 seconds where friends or family can reach it, someone is going to be snapping your picture.

Haiti is a lot more casual regarding public displays of affection, and it would be perfectly normal to see two people holding hands or with their arms around each other in public. The OP said they only submitted a few pictures, and I'm guessing these were probably too "touristy" for the CO. If it isn't obvious from looking at the photos that these two are a 'couple', and not just part of the same tour group, then the photos aren't very good evidence.

When people refer to photos as secondary evidence, they are talking about using photos as evidence of the two year meeting requirement. When it comes to evidence of a bonafide relationship, I don't think there really is any sort of classification like "primary" and "secondary". I think all evidence that shows a genuine relationship probably has equal weight.

I've been very fraustrated with the Haitian embassy.....but you're making me laugh:-)they are such pain. they asked about 10 interview questions and my fiance respond to all of them then they made him sign as if everything was done and approve then she paused and asked him for more pictures showing intimacy. I should of send them some nasty pictures of us and make them mad. they're pain to deal with.

For Haiti, 4 pictures is probably insufficient, to be honest.

I believe pictures are often very important and do convey a sense of the relationship as they are one of "the most often asked for" pieces of evidence.

I took around 300 for my interview and although nothing was asked for, I'm glad I had them. They were organized according to importance (him with my parents, me with his mom, with our college friends, some cute kissing pictures, some in front of tourist attraction spots, graduation day in college, us with our friends). I had a separate album for our wedding.

I hope you hear back something soon! Good luck and keep us posted.
