So back in Jan my husband and I were in a very minor car accident. We were stopped behind someone at a stop light, and hubby thought the light had changed and started rolling forward and ended up rear-ending the vehicle. There was a bit of damage to my car (more due to the fact that we hit a SUV so it hit kinda under their bumper). Since we were stopped and not even a car lenght behing them it would have been near impossible to be going more than about 10km/h. The airbags did not deploy on either vehicle either. We have just recieved 2 lawsuits from 2 of the passangers in the vehicle...one for $275 000 and the other for $235 000 they are claiming that they can no longer work, earn a living or have quality of life because of this accident!!!! I have been hit in the exact same situation a couple of times before (and a couple of times much harder) and I couldn't even imagine how they can claim they have the injuries they have.

Why are americans so sue happy??? I never really paid attention to what insurance coverage my husband had, and I was just added onto his policy and we don't have the best coverage (I am to blame since I should have looked into this more) so I am getting pretty stressed out that if they don't reach a settlement and it goes to trial we may be up the creek. We are struggling to make ends meet as it is, and this is definitley one more stressor that we did not need :crying:

I"m sure it will get sorted out - we were hit from behind at a red light just like you've described while wer were stopped - the lady behind us accidentally hit the gas instead of the brake...we bumped forward and back and may have bumped our heads on the head rests, but not hard...the speed just isn't enough to do anything....I had a headache that night and that was about it. I'm sure the insurance companies will straighten it out...if the air bags didn't deploy they can calculate how hard the car was actually hit...were they wearing seatbelts? If not and it's the law they can't really complain about it can they. If it goes to trial and they lose - will they not have to pay your court costs as well?

Americans appear to be sue happy because there isn't enough legislation in place to cap the ability to make these types of claims.... and our society generally is trained to blame and take advantage instead of taking responsibility for themselves.

I hope this works out.

From what is written in the summons they are trying to say that we didn't stop at all, but they also said that we were following to close, so in effect saying that should make their case weaker since the closer to them we were, the less the impact would have been!!

I am not sure if they were wearing seatbelts or not. When we called 911 to report the accident, they told us ambulances were already on the way and to stay in the vehicle. But if they were wearing seatbelts, then they should have injuries from the seatbelt if the impact was as great as they are stating. If not, seatbelt use is the law, and by not using them, they were negligent in providing for their own safety.

My husband was not issued a citation of any sort for the accident, so hopefully that should work in our favor.

The insurance company is covering the litigation for us (so providing a lawyer and such) so I don't know if they insurance company would go after them for court costs if they lose. Maybe I should be going to the doctor for all the stress this is casuing me. If we win, then we could file a countersuit on them for the undue stress that they have caused.....LOL (I am kidding)

Sheesh - so which was it - they thought you were following to close or you were stopped behind them at a light.....seriously.

There is always someone trying to make an easy buck...pathetic. Love the counter -sue idea

Timeline

As Some of you know my wife and I are in Managua Nicaragua for the next few yrs. Our Honda CRV is being shipped down and should be here any day. But we want a second car! So like 1.5 weeks back we found out a gal that worked in the same area as my wife was selling a 2002 RAV4!! So we contacted her and said love to see ur rav4!! Long story short we found it acceptable--not great, but who cares, its Managua!! She tells us that she had it at the Toyota dealership garage here and they said all 4 Oxygen sensors had to be replaced! And she believed them!! I said thats very odd that all 4 would go at the same time!! We agreed on $8300 for the RAV4 with all 4 O2 sensors replaced!! So I took it back to get it looked at. Found an English guy to speak with and I told him it was very odd that all 4 O2 sensors would go!! So after MANY hours (nothing happens fast in Nicaragua--seriously) They come back with a list of things that are wrong with the car!! NOW only 2 sensors are bad,lol and they ONLY recommend the other 2 be changed! Long story short, the gal doesn't want to budge from the $8300 even though the the repair expenses are less now and she even said the $8300 was based on all 4 O2 sensors being repaired!!

So She comes by and I say, maybe to simplify things we just take the car as is--no repairs. She says yes that would be much better! She wants $8000 we want $7800!! So I say I'm happy to meet in the middle at $7900. She says ok!! We have a deal. But I can see she is not happy!! She comes back that night drops off the car. They could not finish the car buying paperwork that day, so I Ask----Are you happy with the deal, as it doesn't appear so?? She says no, her dad tells her she can get at least $8500 for it and she is like giving the car away!! I said, hey, I want you to be happy, I don't really need the 2nd car and its worth no more than $7900 to me. So I say sleep on it, if you want to take the car back, I'm happy with that! If you think you can get more $$$ go for it!! I emailed her the next day and said, no big deal if you want the car back (no $$$ had exchanged hands yet) but please let me know by 1300. She emails back, ya I'm not sure, wil let ya know by 1300!! SOO I cal her and say, ur not happy, would it be better if you just take the car back? I have no problem with that. Hapy to buy it at $7900, but if you think you can do better, go for it. She said YES, it would make her feel better. See where I'm going with this?? lol

So a few hours ago my wife calls me up and says guess what?? We backed out of the deal?? I say what!!! People are talking about us, saying this chick (dont want to say her name) sold us the car, BUT then we backed out of the deal!! Holy #######!! Really Ticks me off!! I did the honorable thing and said she did not have to stick to the deal, as she was not happy!!! And she agreed to it!! I was ready to transfer the $7900 to her account. I'm livid!! I'm hoping its just a play on words and things got mixed up, but still!! And another thing that ticked me off. On the last night I had the vehicle, she drives up with all the windows partially down! and Yes I found that weird as its super hot here, like 33C!! Why would you have ur windows down with the AC on????? I did roll up the windows that night. Next day after the deal is off I go and put some papers in the car and holy ####### did it smell MOLDY!! It was terrible!! When we test drove it, there was a slight smell, but I figured it was just because it was dirty inside (and I love to clean cars!!)

Just ticks me off that these rumors are going around, and were new here, do not need that childish #######!! And how she was hiding ####### about the car!! Whewwwwwwwww, lol But the truth will come out!!! I hope she can sell it as she is soon leaving here. And there is no way she can get anywhere close to what she thinks she can get in the USA! It has dents/scratches/dings, its dirty etc!! Oh well, life continues, lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

Well - $2800 isn't ####### ( lol ) he could certainly buy something good for less (I am currently building my own gaming machine for about $1400 but waiting on sales)

You guys need a budget - not spending a single dime is rough too - how does he get to spend $2800 and you spend nothing? I think I'd be ticked.

ah the incompetence of onstar!

about 2 months ago, the onstar subscription on wifey's gmc terrain expired. i renewed it for 4 years. all is well, right? uh no. onstar had a problem with their computer system and charged me .96 for another month subscription even though i renewed her subscription for 4 years. i called back on that - they offered me 3 free months on the pontiac vibe to make up for it. sounded good, 3 months for .96 cents.

well, the inept representative i had added the 3 months to the wrong date (end of the first year subscription instead of at the end date) poof, i had a positive balance on my credit card and i now have only 9 months left on the subscription.

so on friday i call back in, get a fairly capable representative this time - he fixes it. one problem - it will be $50 more to do so. he offers to give me 3 months extension on the subscription. i did the math real quick and discovered i'd be out $11 on that deal overall, so i convinced him to give me 3 free months on both vehicles (as it was their screwup!). good thing i broke it down by a per monthly cost basis ($13) otherwise onstar would have made money outta the ineptitude of their people.

:ranting: grrr!

Vent #1 This dang vent thread was a pain in the butt to find. Ok not really a vent but hey.

Vent #2 My parents, my mom wanted to come down for 2 of the kids birthdays. Alanna will be 17 and Alexis's first Birthday, well she tells me that my dad says they can't come down cause they got no money. This is total bull. I'm so sick and tired of not being a priority, a concern or even a freakin blip on his radar. If I was my sisters they would be down here several times a year. They sold their house so they could be free to travel, not have to worry about pipes freezing or maintenance and what not. My father is 69 not too old at all should be enjoying his life my mom 60 she is not retired yet but my father is. Anyways, instead of doing things my father sits around all day complaining of everything. If he gets real bored he hits the casino and will not even blink or bat an eye when he looses 1k in a few hours. I could care less what he does with his money if he didn't try and pull the ####### of how he has no money. All they need to do is pay for gas when they come here nothing else.

Then the other thing is they have a car that they gave my sister, she was supposed to pay to get the mechanical on it and get it transferred to her name etc. Well she couldn't be bothered and just kept diving it around while they payed for the insurance. Well my sister is a terrible driver she wrecks every car she has owned so finally after almost a year my parents tell her she has a month to get it done cause they canceled the insurance on it. Well my mom says she wants to give it to my older boys to have. I was going to look into what all it would cost to bring it here, taxes, the duty, compliance letter and such, but I don't want to bother cause I know when I get it all figured out my dad will pull some ####### saying he wants us to buy it from him instead of just giving it to us. It would be just cheaper and easier for my son to buy his own car here.

I just want to grab both of them and tell them to grow up and do something other then waste away and die (my dad sure seems to be doing just that). They always say they want to get an RV and travel but they don't it's just very frustrating.

Sorry if i don't make sense I'm probably all over the place typing fast before I need to chase a baby.

so in the beginning of April we moved into a new house and town. We are kind of in the country but not quite. It was so nice and peaceful here for the first few weeks. :) There are two houses on one property, the land lord lived in the other house but he moved out and was in the process of renting out his house when we moved in. The new people finally moved in about 2 weeks or so ago and it hasn't been peaceful since  .

They have two dogs, a doberman and some other small type dog. The little one especially will bark at everything it sees or hears. And if we go outside the little dog will bark the entire time we are out there :wacko: The doberman isn't as bad but his bark is deep and resounding. All the barking is really driving me crazy. They just leave the dogs to run around their back yard, day and night. Their back yard is connected to the front of our house but is separated by a fence. I think the dogs are bored and that is why they bark all the time. As far as I can tell they never take them for walks and I rarely hear them tell the dogs to be quiet.

I told my husband we should do or say something about it but he doesn't want to

My first vent in a couple of years! I have missed this forum.

I need a certified copy of my probation record for my ROC. NO ONE is capable of getting this for me. I keep getting told it has to come from my probation officer. Yeah, hey, who do you think I called FIRST? :bonk: She can't get it to me because I am in Houston, and something to do with paying for it. Apparently money from a person currently living in the US is no good there. ARGH! So, I have no idea what I am going to do.

OK, end rant. Other than that, everything is going swimmingly! Oh, except drivers in the left lane on the freeways here seem to be scared of the gas pedal. The fast lane is the middle lane. Stupid.

Marilyn---I hate dogs that bark all the time. I have 2 dogs now had 3 but one had to be put down, and I refuse to have them outside just to bark. They drive me nuts I can't see how ppl don't go crazy with their dogs barking all the time.

ValerieA--- That sucks, I hate tracking things down like that, ppl always want to give you the run around. I had no problems getting court records from the court house once I got hold of the right person. She even sent me several with the court seal and everything at no charge.
