Hi All,

Just found out about this site from a friend... and have been trolling through this Forum all morning and I am sure the answer to my question is in here somewhere..

I live and work in the UK on a Tier 1 visa. My fiance is British. We want to to file for the K1 and eventually settle in the States.

Because I live in the UK, can I file the I-130 at the Consulate.. and do everything from here?

11/25/07..... I moved to the UK on a work visa to be with him 🙂

09/02/10..... NOA1

A K1 is a fiance visa, and only spousal visas can be filed via DCF. So you can either get married, then file for a CR-1, or file for a K1 via the USA (you would need a mailing address in the USA- somone who can forward papers for you).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

One thing: DCF is much quicker, and many report easier (my interview took less than 5 minutes!). If your concern is getting married in front of family in the USA, one thing you might consider is a quick legal wedding in the UK- or elsewhere-, then vile for the spousal visa via DCF and have a non-legal wedding/ blessing in the USA with reception and everything. Even with a K1 you might have to end up doing something similar, as with a K1, you need to get married in the USA within 90 days of arriving, and as you don't know exactly when the visa will be approved, it can be difficult planning a big wedding for within those 90 days; because of this, many K1 couples get married legally in a courthouse as soon as thefiance arrives, then get married religiously months later, when there is time to plan a "proper" wedding.
