Hi all,

I am currently within the final stages of my AOS application, from a K-1 visa holder to a permanent resident. I've had a family bereavement, and am looking into obtaining the advance parole document to make a visit the UK, for the funeral.

I believe my permanent resident card is almost ready to be issued, as I had my biometrics interview around 1 month ago.

Does anyone have any advice on how I would go about applying for advance parole, and how long it would take to be issued. Any information would be helpful as I have to move quickly.

Because this is AOS, you (the beneficiary) can call USCIS to try to learn a status update. Even better may be to set an InfoPass appointment to explain your situation and learn what can be done. The question is, did you file for Advance Parole simultaneously with the AOS? It sounds as though you didn't, in which case you'd almost certainly have to wait for your green card.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

No, you CAN send your AP application now and take the chance that it comes sooner than the green card. You can also do an InfoPass appointment to try to quicken that process. Just because you had your biometrics doesn't mean the green card is imminent; look at our timeline for an example of what USCIS is running time-wise.

Send in a copy of your NOA1 for the 485 so that they don't charge you a fee for the AP (it's free when filed with the 485).

Sadly, there are so many backlogs that I think it will be quite difficult to get this done in time. I think your best bet is to talk to someone in person. Find the closest location to you that deals with these things and go meet with them. I know we live in a very digital age, but a matter like this one is best dealt with on a face to face basis. I can't guarantee you anything, but your chances for success will be much greater if you talk to a government employee in person and get them involved in helping you resolve this.

Get an Infopass appointment: https://infopass.uscis.gov/info_en.php, where you can take your AP form (since it sounds like you haven't applied?) all your ID and proof that you need to leave the country immediately (death certificate, if available).

People are able to get expedited approval for these things.

My husband is in the same situation as you are.

Based on the timelines, we expected AP to arrive this week- but it hasn't. We went to an Infopass appt in Milwaukee to try to get an emergency document and were told that these were no longer issued at the office. We called USCIS immediately and were able to file for expedited AP over the phone. We hope they don't ask for evidence, as we can't come up with any for a very sick aunt in rural Guatemala. We were told to expect a decision within five days.

Today is Wednesday, and the flight is scheduled for next Monday! PRAYING the decision is made quickly! We'll let you know what happens.

• July 28th, 2009: I-129F Petition packet sent from Milwaukee, WI

• July 30th, 2009: I-129F Petition packet arrives in San Niguel, CA (per USPS website)

• August 8th, 2009: 1st NOA received
