Hi-

My wife is here with me in the US on a K3 visa, and is discussing doing an AOS in the US with the USCIS to obtain permanent residency status.

However, we had already started the process of applying for a CR1 visa via the NVC. At this point though, it would be highly impractical for her to have to return back to her home country to have it processed over there via the consular route.

I've paid the Affidavit of Support fee to the NVC and they have sent me form I-864 and D-230 to complete and send back.

Should we abondon the NVC route at this point (i.e. not return the forms) and just go with the AOS stateside?Could I follow both tracks simultaneously? Your advice & clarification of the options would be greatly appreciated.

You can notify the NVC that your wife is in the US on a K-3 visa and you will be adjusting status in the US. They will then send the approved I-130 petition back to USCIS.

I understand that you already paid AOS Fee Bill ($70.00) and IV Fee Bill ($380.00). But you prefer not to go back to the Embassy for the CR-1 interview.

Anyway, if you want to do the AOS in USA, you need to inform NVC so that they are aware of the situation and stop the CR-1 processing. Now, once NVC is aware of it, you can not change your mind. So in my opinion, you are better off concentrating on AOS process in USA. The good news is, your wife is with you. So just forget about what you paid NVC for your CR-1 process.

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Could I follow both tracks simultaneously?

My understanding is that you can't follow both as the NVC will not release your I-130 to the USCIS until you cancel the CR1 and the I-130 is needed by the USCIS to process the I-485.

You don't need to send the affidavit of support to them. Just send a letter/email with a request to cancel the process and notify them you will do AOS here. You will need to file an I-864 during the AOS process.

Just a curiousity question

If you have your K3 visa and go back for the CR1 interview, has it ever happened that you could be denied that visa??? If so what happens to the K3 will they take that back too?

How about changing the location of the CR interview to canada or mexico or someplace closer can that be done??

OUR K-3 INTERVIEW WAS ON NOV. 1ST @ 10:00!!!

VISA APPROVED!!!

WE ARRIVE IN THE USA ON NOV. 10TH!!!
