Then she said she will make her decision and we will be mailed a letter in a couple of weeks. She didn't come right out and say we were approved so then I felt nervous with the "not really knowing for certain" factor, but hopeful since she'd seen a lot of our evidence and took his I-94 and crossed out his K3 visa in red that it's a potential approval she just has to take time to read through the 5 letters of support and review everything.

Hopefully you will hear good news soon.

Well being 28 weeks pregnant, I think I will have some issues finding a job!!! But fortunately I come from a country that has unemployment insurance that can be used when you are living out of the country (since it is a fund that the employee pays into) and I meet the requirements for that. BUT in order to get it....you need to legally be able to work!!

I just got a follow-up e-mail from the Congressman's office and upon further conversation with INS...my interview (and the need to travel to Memphis) will be waived!! All this good news is going to make for a good weekend for me!! Thank you everyone for your support!!

Awe! luv.gif Super Awesome! I am soooo happy for you! (L)

Hopefully you will hear good news soon.

We did!

Got home this afternoon and the USCIS website updated and sent us an email that our 10 year green card is approved and our card production is ordered! kicking.gifkicking.gifkicking.gif

It says to allow up to 30 days for it's delivery!

Whew. We were sweating there a little bit. blush.gif

By the way, anyone shed light on how and why some folks get a 10 year green card and others the normal 2 year green card? Is it K3 vs K1?

I got a call from the congressman's office today, and they confirmed that that Nashville office is SEVERLY backed up, but because of my pregnancy and limited window left to travel, they are going to take me as a walk in on Monday!!! Apparently my EAD has been apporoved for awhile now, but since there is no biometrics...they can't issue it. Also I was told that they never recieved any passport photos with my I-485 (which I know 100% I sent) but I never recieved an RFE for it nor did my online case status indicate that there was an RFE, so apparenlty my I-485 has been on hold, but they are going to take my photos on Monday when I go, so hopefully that will get everything moving along quickly!!!

Great news! Now, you can relax. :)

If you're married less than two years, you get a conditional (2 yr.) green card. If 2 years or more, then, you get a 10 year GC. I think that's how it works.

Here is the link where I posted my AOS Interview Experience. Good Luck to all!

@Cleo, Good luck on your interview tom :star:

Thanks!

Yep, that's how it works! good.gif

We've been married for nearly 4 years so we were up for the 10 year non-conditional green card and got to skip ROC. It's safe to say nearly all K1's are going to be the conditional 2 year green card and their next step is ROC.

Our next step is Naturalization. From the day we receive his GC we can start counting down to when we can file for Naturalization. It's 3-5 years before you can file. The 3 years is if they've lived in the US consecutively with their spouse for that time. The is a 60 day window before the 3 years is met that you can begin filing. The 5 years is if they've divorced or separated from their spouse and lived within the US for that time and want to Naturalize on their own. They can't have been out of the country for more than 6 months at a time or they risk losing their Lawful Permanent Resident (LPR) status.

Naturalization is said to be the easiest part of the entire immigration process. Then you're done for good and no more spending money on immigration!!! Otherwise the paperwork and fees never end. One could keep applying and getting the 10 year green card or they could go back to their home country and go out of status. I've known some to do that after a divorce here.

Hi Cleo,

I just want to ask something about the highlighted sentence above. I've been here in the US with my husband for 2 years now (never left the country) and my 10 yr. GC just got approved. You mean to say those 2 yrs that I have been here doesn't count in applying for Naturalization?

Unfortunately that time doesn't count. :( It counts from the day you're approved for AOS and get your unconditional green card. They go by the date on the green card.

Here we go: It's based on being admitted as a lawful permanent residence (LPR) and will be asked to produce the I-551 stamp as proof.

This link has the Naturalization Requirements.

And this is the Naturalization Guide along with forms to submit.
