I-129F to NVC First Intentionally?

Well there it is. Looks like they are actually doing what they said they would do.

I-129F Sent : 2008-04-08

I-129F NOA1 : 2008-04-14

I-129F touched: 2008-05-06

I-130 touched: 2008-05-09

I-129F approved 2008-09-05

I-130 approved 2008-09-05

NVC received 2008-09-12

Pay I-864 2008-10-08

Pay IV bill 2008-10-08

Receive Instruction 2008-11-05

Case Complete 2008-11-18

Medical 2009-01-19/20 passed

Receive Pkt 4 2009-01-30

Interview 221g 2009-02-23

Second interview 2009-03-02 Approved

POE DFW 2009-03-07

Received SS card 2009-03-17

Received GC 2009-04-01

Done for 3 years or 10 years. Haven't decided yet.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Well there it is. Looks like they are actually doing what they said they would do.

We have numerous reports of "they" NVC doing exactly what they said they would do. What we don't have is ANY reports of "they" USCIS honoring a request to hold the I-130, so that the I-129F can arrive at NVC alone or ahead of the I-130. That's what this thread is actually about.

We don't have reports of anybody even TRYING to get NVC to reopen the I-129F case.

The OP's case is one of those where K3/4 has real benefit but because this is not one of the actual intended benefits of K3, I have little hope any such request will be granted. It's certainly worth a try though.

i forgot to ask how long this will take? ie. if i try with the letter asking explicitly processing the k3 first and they reject it and tell me to do the IR-1, what kind of time frame am i looking at? week? month? any help?

Don't expect any response at all to your request. They will process both petitions together and approve them the same day as per usual. You actually WANT them to do that. All you want them to do is hold the I-130 for a while. You'll find out whether they did or not when you see the result. The prudent course of action, IMO, is to proceed as if your request will be ignored.

Right but how long until "I see the result"? That is my question, will I not know for 6 mos?

If at all possible I'll be pursuing the other course of action at the saem time but I think the registration of birth (I don't know of any way to expedite this in Canada, if anyone knows differently please lmk) and birth certificate are going to hold me up as I assume I need those to file an I130.

Fill in your timeline and you'll get an estimated adjudication date based on the reports of others but generally, petitions are being approved in about three months. Then, they are sent to NVC. You can contact NVC and speak to a human about status of each case.
