Diversion

My husband recently got a ticket for fishing without a fishing license! Apparently it's a big deal because they put him on pretrial diversion so that it would be taken off his record after 6 months. It's considered a traffic violation ~he wasn't arrested just given a ticket and had to pay some fines for diversin-no court proceedings or anything. Do we need to include this with the I751? So ridiculous!!!

It sounds like where you live it is treated like a driving infraction.. much like a seatbelt ticket... he's lucky.. in many areas it is a criminal offense.. a misdemeanor...

IMO he should note it since it went through the legal system and is on his record.... DHS and all of the others have it in thier system and if left out it could be an issue much bigger than having it there... its easier to explain what happened that trying to explain why it was not noted..

Thats what I was thinking too- I think it would have been a misdemeanor had he not taken pre trial diversion. Just crazy IMO.

Except on the I751 it says except traffic regulations (unless alcohol or drugs were involved)- meaning it shouldn't have to be included since the courts show on his paperwork that its from traffic court. I don't want to hide it, but at the same time I dont want to raise flags that don't need to be

Again be safe than sorry. My husband has his interview for Citizenship tomorrow and he is submitting traffic tickets(even though NOT drug or alcohol related). We know of people who were asked to show proof that their tickets were simply paid.
