Refused Entry Question

Timeline

Sooo...I've been refused entry into the US one time (before we started our immigrant visa journey).

At the time of the refusal, I got pulled into secondary and was issued a Withdrawl of Application for Admission/Consular Notification.

It says:

Basis for Action(check all that apply)

Application for Admission Withdrawn is checked

Reasons

In CBP Secondary it was determined that subject would need to establish solvency within Canada before applying for admission to the United States again. Suject's application for admission to the United States was withdrawn under section 212 (a)(7)(A)(i)(I) of the INA.

Could this have a negative effect our application? Of course, on the DS-230 where it asks if I've ever been refused entry, I will be honest but I just wanted to know what others thought...

Timeline

It won't be a problem. You will, however, need a visa to return to the US in the future.

05/01/2013 - Removal of Conditions - APPROVED!

Actually Jim, if she wants to return to the US as a visitor, she does not need a visa to return. I was refused entry twice and returned for a visit after the refusals without any visa required. The rules work differently for Canadians.

Sweetcheeks, it won't be an issue. Tell the truth when asked about it at the interview, and yes you will be asked about it, and it won't even be a concern for them.

The section of the INA quoted on the document she got specifically refers to the requirement for a visa or other valid entry document. Maybe it's a boilerplate denial slip, and the INA reference doesn't mean anything, but if I had gotten that slip then my interpretation would have been that they were saying "We don't believe you won't stay. Go get a visa.". :blush:
