A few I864 Questions

Timeline

I have a few I864 Questions. I am 24 years old and have only filed tax returns for 06 and 07 beacse those are the only 2 years which I have worked. Last year (09) I worked but it was in Australia. So, how do I fill out Question 25? And will I have to type out an explanation as too why I have only filed for the two years? I have a cosponsor, will this still effect the visa?

also, for question 21 C, It states to put 1 if you are married, yet I have already claimed my husband above, do I still put 1 or do I put 0 there?

You can enter "0" as you already claimed him...

Even if you worked outside the U.S. there are rules and you MAY have to pay taxes on the money you made in Australia. Check with the IRS they should be able to tell you if you need to file or not.

4/20/2010 - NVC email with AOS and IV bill

4/23/2010 - AOS fee paid & package send

4/26/2010 - IV fee paid

5/21/2010 - IV pack mailed to NVC

5/28/2010 - NVC received IV packet

6/10/2010 - SIF & RFE (for PCC different for Sir Lanka)

6/11/2010 - CC (with RFE)

You did work, so you very well may need to file, even if you worked in Australia. Just to echo, check with the IRS.

You very well may not have to do anything...I am not sure what the exact law is, but hopefully you have or will look into it.

I already checked, and I didn't make enough overseas to have to file. So, I don't have tax returns for 08 or 09, what do I put for question 25? Just 07 with an explanation as to why I didn't file for 08 or 09? and do you think this will effect things, even though we have a co-sponsor?

Someone will come along and correct me if I'm wrong, Don't check the box, list the 07 info, put "N/A" for the most recent and 2nd most recent...and than attach an explanation as to why you were not required to file.

I know of a recent case where the USC spouse was not employed and didn't file taxes for the last 2 tax years.

They sent a statement explaining the reason for not filing, but they just got an RFE (Request for Evidence)

And I believe they even have co-sponsors for i-864 which they already sent tax documentation for.

So if you send your 864 now with just the statement you may get an RFE later. But maybe you won't

However there is a way to get tax transcipts from IRS

And I believe that if you didn't file, you will get a "verification of nonfiling"
