k3 for us citizen marrying canadian citizen in canada

Hello there

I am a US citizen who is going to marry my canadian citizen wife in canada on june 26. After the wedding on june 26 if we go to city hall and get our marriage certificate what is the best way to apply for her permanent residency?

I was going to apply for an I-130 however someone told me she cannot visit me during the period where it is being processed (8-12 months??)

This is why I wanted to do the K3. If I do the K3 can she visit me from when until when? Can she visit me right after the wedding? Right after the paperwork for the K3? Does she have to wait for anything when the K3 paperwork is started?

I just am afraid of doing the I-130 because she cannot visit me in the states for the 8-12 months of processing hence why I'm leaning towards K3.

Any info or tips would be greatly appreciated!

Hi

K-3 visa is not usefull anymore because nowadays it takes the same time than cr-1 and in both cases k-3 and cr-1 takes at least 6 or 8 months and your wife should wait abroad

As long as your wife show strong tides to Canada she can get into USA via waiver. But honestly what happen in a POE is a matter of luck.

K-3 visa is not usefull anymore because nowadays it takes the same time than cr-1 and in both cases k-3 and cr-1 takes at least 6 or 8 months and your wife should wait abroad

As long as your wife show strong tides to Canada she can get into USA via waiver. But honestly what happen in a POE is a matter of luck.

How can she show strong ties? I don't understand why she cannot just visit. Should she show a letter from her work? What if they say no? She has to eat the cost of the ticket and just go home????

Start doing your homework by clicking on the word "Guides" at the top of any page here. K3 is dead and Canadians routinely visit during he process if they handle the border crossings intelligently. Visiting during the process, particularly from Canada is the most FAQ.

K3 is obsolete for all practical purposes.

Yes, the border can and will say no. They can and will say no because being married to an American can indicate immigrant intent. If they believe your wife is trying to enter as a tourist with immigrant intent, they will deny her (as shown when I was denied entry). If that happenes, yes your wife has to 'eat the cost' of the return trip. To avoid this, your wife will want to show ties to Canada. Such as a lease/mortgage, a letter from her job with an expected return date, school that she must return to, etc.

What province are you marrying in? If it is Ontario, you must wait at least 6 weeks before your marriage certificate will be issued and you need this for the I-130. This is the same for many provinces. Also, your wife will interview in Montreal for the visa as Montreal is the only consulate in Canada that does the Cr-1 interview

Hi

a way to show strong ties to her country would be:

- documents showing ownership of an apartment or a house or anything that could be considered important for her

- a leasing contract of the play she lives.

- Letter from her job

Finally all documents or evidence that testify by itself that she needs to live in Canada and she is not travelling with the intent to immigrate to USA.

Of course, normally those things work fine, but the last word belongs to the board officer at POE. She needs to feel so confident and doubtless by the time she is interviewed at POE.

I also got stopped and sent to secondary when I tried to cross, once they found out I had an immigrant visa in the works, the border guard wouldn't let me cross, and I had TONS of evidence to show I was going to come back. Heck, my son (whom I have sole custody of), who's ALWAYS lived with me since day 1, was still enrolled in school in Canada, I brought a letter from his school and that didn't matter, they said the intent to stay was too strong so they wouldn't let me thru.

Yes, then they send all the paperwork to the Registrar General's Office. You can click here to figure out how to get your marriage certificate after the actual marriage. It'll take about 6 weeks (unless you expedite it)
