I-864 and I-864a package - is this OK?

Hi Everyone,

Based on the step-by-step instructions, my sponsor (my wife) and her mother (household member) are going to submit the following. Can you tell me if this is OK:

* completed I-864 by Sponsor

* IRS transcripts for 3 most recent years (we realise 2nd and 3rd years are optional, but best to be safe)

* completed I-864A by Household Member

* IRS transcript for most recent tax year -- OR -- photocopy of tax return + W2 + Form 1099 for most recent year

* Every Form 1040 Schedule, if any, that household member filed with Federal Tax Return (she owns a business)

* Evidence of ownership and value of assets (in this case LAND - does that need a recent reappraisal?)

* Proof of relationship (Sponsor's birth certificate will show this)

* Proof of same residence - bills. This is a bit tricky as they have a PO BOX and all mail goes to that, so any suggestions welcome? Maybe a covering letter?

Is this sufficient for the I-864 package?

Also, does the HOUSEHOLD MEMBER need to submit proof of US citizenship - i.e. birth certificate? If so that would be an extra item on the checklist.

Yes, the Household member has to prove their citizenship or LPR status. I would also include the last 3 years for your household member. That way they can't tell you that they are missing and make you wait longer for your visa. I would also include a recent appraisal for the land. One is needed for a home but the same will probably go for the land. Better to cover all bases then to be handed a RFE.

-AOS Fee shows as PAID & paid IV Bill: 6/15/10

-IV Bill shows as paid: 6/6/10

-Received IV instruction packet: 6/8/10

-Received dox from co-sponsor: 10/14/15/10

-Sent AOS package: 10/18/10

-AOS package received: 10/19/10-J.Desmond

-IV Package mailed out: 11/3/10

-AVR says I have an RFE: 11/5/10

-NVC operator told me what my RFE's are: 11/8/10

-NVC sent checklist letter (for the 2 AOS RFE's): 11/13/10

-NVC operator says the IV package has been entered: 11/18/10

-E-mailed SUE to see if that would do anything (3 diff times...): 11/29/30/10

-Sent AOS RFE's: 12/1/10

-AOS RFE's received: 12/2/10

-Checked payment portal for fun (SIF!!!!): 12/3/10

-AVR still say AOS missing info: 12/3/10

-NVC operator says case was shipped to USE in Lima: 12/3/10

-Received interview date (12/13/10): JANUARY 6th, 2011!!

-Medical: 12/21/10- Passed :)

-Interivew: 1/6/11- PASSED :D

-Visa received- 1/13/11

-POE FLL- 1/23/11 YES! BUTTTTTTT....still not reunited :'( (Reunited on the 24th)

How can I prove they live together? They have a mailing PO BOX address which all mail goes to, but their residence is different? Maybe a notorized letter from the sponsor, together with bills going to the same PO BOX?

That sounds good.

Just a note that a 'business' can't sponsor an immigrant, only a person can, so the individual income or land value might be key here.

Yes, that's right - the reason we're using land value is we think her mother may not pay herself much of a wage. The land value is colossal, though, and they can get an appraisal very easily as they've had lots of offers recently as its highway property.

Worst comes to worst we can use my wife's father as another household member, who earns a good wage, but the less complicated we can keep it, the better.

Do they live together in the same residence or not? If they don't, the mother files an I-864 not the "a" and must qualify on her own. No combining of income unless they live in the same house.

I'm 100% sure but I read that someone used a photo copy of the driver's license to show the address...Also if not bill's you can show voter registration.

6/10/2010 - SIF & RFE (for PCC different for Sir Lanka)
