it got lost in the mail!!!! help!!!!

we sent out the AOS application packet last may 25 via usps and its supposed to be there by may 27..but up to now it hasnt been received and the usps people cant tell us where the heck is our package..what should we do? my fiance's visa should be expired by june 10.

As payxibka said, if she's still your fiancee then she isn't eligible to adjust status. :blush:

Your fiancee's visa expired the day she entered the US. What is going to expire on June 10th is her I-94. As long as you were married within 90 days of her arrival then you don't have anything to worry about. She is eligible to adjust status based on the marriage regardless of whether the I-94 is expired or not. Some people have waited months or even years after the I-94 expired before sending the AOS petition, and still got a green card without any problems. Relax.

Technically, if you don't have the NOA1 from the AOS petition by the time the I-94 expires then she will be out of status. The worst that is likely to happen as a result of this is that you would some additional explaining to do in the unlikely event you had an encounter with immigration officials.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

oooppss sorry i should have said my wife :)

thank you for the advice it sure made me relax but i cant help getting frustrated with usps because if they do lost it then it means we have to make another application :/

Did you send it with delivery confirmation? To the lockbox or PO Box? Give it another few days to see if USCIS cashed your payment.

01/2006 - Filed k1(1st time)

I had that issue with me passport application which was finally found. As previously asked, did you use any kind of tracking method? I called the post office with my tracking number and complaint, and they were able to locate my package. It was in the right place the whole time, but someone just forgot to scan the tracking barcode. Hopefully that is all that has happened with you. If your check is cashed, you will know it is there and hopefully be able to see a receipt number on the back for checking online status. Good luck!

Since you seem to know for certain that it's lost (you said USPS can't find it) I'm presuming you opted for delivery confirmation. Otherwise, neither you nor the post office would know for sure whether it's lost.

If you sent it Express Mail then you were given a specific delivery date. If it didn't arrive on that date then you need to report the package as missing. If you sent it Priority Mail or First Class then you're supposed to allow 15 days for delivery before reporting the package as missing. The post office requests that you confirm with the recipient to determine if the package may have actually been delivered. USCIS is unlikely to be of much assistance with this, and they'll probably claim they don't have it even if it's sitting in a bin in the mail room waiting to processed into the system. Your best option is to wait a reasonable amount of time to give the post office and USCIS time to pull their heads out of their respective hind quarters. If, after three or four weeks, neither the post office nor USCIS can confirm that the package exists then you can probably assume it's vanished for good.

If you decide to give up on the package and presume it's lost for good then be sure to stop payment on the check before you send another package. You should also tell the post office you want to recall the original package in case it's eventually found. Hopefully, this will prevent them from delivering it, and they'll return it to you instead.

Tracking about USPS Letter which I always do, go to www.USPS.com then Enter your Number in the Reciept, Start with EG then number then US, or Maybe It is not Lost, Sometimes it depends on How far it may Go, from your place to the Destination, and it Happens you mail it, may 25, sometimes even USPS takes a week to be there and don't forget ,the date of your mail to atleast one week longer , and it fall in between of sat,sun, And Memorial Day, that will be + 3days more, Just be Patient, maybe this week will be there, how to know that, Check your Bank Statement if the Amount you write in the Checking been Cash Out , if that so, It means It is in Good hands and wait for the Letter of Notification from USCIS, well your wife is Married to you already, It means She is legal to Stay because , she in AOS process. Wish you all the Best.
