Hi all VJ,

My wife's interview is next week. Just found out that I make 2 mistakes on my G-325a today: wrong my father's birthday 1951 instead of 1952, and 2007 I lived in Vietnam over a year (1year+1week) but I did not stated G-325a. What should I do now, email Consulate a new G-325 or bring a new one to Consulate or...?thanks

Let the consulate know about the mistake (email them) and contact your Congress person to help you correct it.

The father's birth year is an honest mistake. It certainly wouldn't rise to the level of material misrepresentation.

Did you declare anything at all for "last residence outside the United States for more than 1 year", or did you leave that section blank?

JimandPhuong,

I left blank on the part "outside the US for more than 1 year". When I first submitted that G-325a to USCIS, my mind thought I did stay in VN roughly 12 months but not over a year. I found my mistake last week from inquiry that I make to Custom Border Protection. I wrote inquiry to Customs Border Protection 3 times, and they did mail me a list of flight in and out US. Don't khow where the first two inquiry have gone.

JIM, How do I approach to CO about it? Honestly explain when I first sat down for interview, or wait for CO asked when that question raised up, and if during the whole interview the Co never mentioned anything regarding the trips what should I do?

My wife will bring document provided by Customs Border for interview.

Geez, this one has me a bit stumped. One side of my brain is telling me that this is material information that should be corrected, especially since you now know that the form was incomplete. The other side of my brain is telling me that the G-325A was submitted with the petition, which has now been approved. Making changes to this document now is essentially asking the consulate to modify an approved petition, which they don't have the authority to do. There's no reason to believe that the petition would have been denied if the information would have been revealed when the document was originally submitted to USCIS, and a finding of material misrepresentation usually only applies if the misrepresented information could directly affect the outcome of the petition or application (otherwise it's not "material"). Certainly, DHS knew about the time you spent in Vietnam when they did the background check on you, so if it was a problem it would have come up by now.

What follows is my opinion only, and what I would probably do if I were in your shoes. Take it for what it's worth...

I would prepare a revised G-325A, and have it ready at the interview. Explain the discrepancy to the CO, and ask them if they want the revised form. I'm guessing they'll probably say "No, we have access to your CBP records. Thanks anyway."
