Need help with DHS regulation for States issuing Drivers license

Hello!

Is anyone aware of DHS regulation which instructs states not to issue drivers license to any beneficiary (AOS for a fiancee) whose I-94 is going to expire in less than 60 days? We are Kansas residents.

We are already married (she has a SS#) and her AOS in the works. Are any states issuing drivers license that anyone is aware of?

What is the alternative if any? Any thoughts?

We are in Texas...so might be difference. You have to have at least 6 months left on your I94 (which K1 doesnt have) before you can take the test.

My wife got her EAD (1 yr) so she use it to take the test. The license expire the same day as the EAD. She has to come back and get it renew once she receive the 2 yr GC

In CA you either have to have your EAD (or green card) or have more than 30 days left on your I-94. (At least I think 30 is the right number). You also have to have your ssn. The license expires at the same time as the document you used to get it.

Drivers licenses are state controlled in terms of what they think they need before they give it to you, so no, there will not be any federal regulations about who they HAVE to give it to, although there may be some agreements about what sort of information they should contain.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

In Kentucky it is only supposed to be good until the I-94 expires, basically the expiration of the legal authorized stay. Then when you receive your green card you can get a new one good until the expiration of the green card? Anyway they gave him a driver's license with a four year expiration initially and we just didn't say anything.
