Is there any alternative way of getting the Fiancée Visa?

Hello everyone,

I am in love with a girl who is living in USA, She is a green card holder but she has to wait for 1.5 year to get her Citizenship. We have been waiting for the last 3 years but it's really getting so lengthy to wait for another 1 and half year and then apply for Fiancée visa that may take 6 months!

I wanted to know if there is any alternate way that we can apply for a Fiancée visa?

Unfortunately, only a US citizen is allowed to petition for a fiance. If your girlfriend isn't a citizen yet and isn't eligible to apply for another 1 1/2 years, there are no other options to get a fiance visa.

You may wish to look at getting married. She could then start the petition process for a CR-1 visa. There is a LONG wait for non-citizens but then when she got her citizenship she would notify USCIS and she would move into a category where there is a visa available.

Either way, the wait will be about the same time. Try to remember that good things are worth waiting for and if this relationship is all that you believe it to be, it will be able to stand the additional 1 1/2 to 2 year wait time.

Do you have millions of dollars and are you willing to make a serious investment in the United States, providing work to many? Or maybe you have certain skills that an employer in the United States is willing to sponsor you as part of a job? If not, you will have to wait like the rest of us...if there was, everyone would be doing it. You can visit on the visa waiver program.

It's my understanding that a Permanent Resident of the USA CANNOT file an I-129F petition, to culminate in a K-1 visa.

OTOH, there is nothing stopping the two of you from getting married - P.R.'s are allowed to file the I-130 petition.

What's more important, the marriage and subsequent life together, or the citizenship status?

If you'd like to come over on an entreprenuer visa, though - we'd welcome you on Friday Morning ;)

It sounds like you've been waiting practically as long as your fiancee has had a green card. If you or your fiancee had done some research earlier on, you'd probably have had a visa by now. The current wait for the spouse of a legal permanent resident is only about 2 1/2 years.

The fastest route would be to get married ASAP and then have your wife petition for an F2A visa. If your priority date becomes current before she becomes a US citizen (which is possible) then you'll be able to apply for a visa. If she becomes a US citizen before your priority date becomes current, she can upgrade the petition to a CR1 (IR1, if you're married at least 2 years at the time), and you'll be able to apply for a visa. In either case, you eliminate the additional waiting time for the petition to be approved.

It seems odd that you would have decided 3 years ago that it would be a good idea to wait nearly 5 years and then apply for a fiancee visa. Why didn't you get married and start the process a long time ago? The question is relevant because it's possible that the answer could affect your chances of getting a visa.

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
