Answer the letter, not answering will default your application to a visa fraud marker. Show a continuing relation, after the denial, phone calls, emails, whatever you have, include a new intent to marry, if possible have the new intent notarized. If the denial was for some factual information, then you will have to address it, for a non-bonfide relation how can you address the denial based on it, being a subjective decision it is? I stated in my response to USCIS that I had no information on the reason for the non-bona fide, so I could not address the reason, though in the letter I did state the relation was bona fide. The end result was the Visa application was sent back to the Consulte and the visa was issued.

How long does it take to process the rebuttal?

When I check my case status, it keeps saying initial review...been almost a year already.

CR-1 Visa

I-130 Sent : 2008-09-26

I-130 NOA1 : 2008-10-02

I-130 Approved : 2009-01-21

NVC Received : 2009-03-13

1st interview Date : 2009-05-22 DENIED Requested chronological time line

2nd interview Date : 2009-06-19 DENIED - Received white paper

Case sent back to USCIS

Receive EOIR: 2010-05-22

Sent Rebuttal: 2010-06-14

NOA rebuttal entered: 2010-06-15

NoA decision: 2011-12-14 CASE REAFFIRMED

3rd interview Date : 2012-03-09 AP

4th interview Date : 2013-01-07

How long does it take to process the rebuttal?

When I check my case status, it keeps saying initial review...been almost a year already.

Unless they changed the system, returned cases aren't undated in the online case status. Like Scott said, give them a call.

There are only a few Officers that adjudicate returns, so there isn't a set time that they reply to them. Also, once your case is approved by the USCIS it will just pass through the NVC and the Consulate will schedule an interview.

I gave them a call and they're basically reading off the website telling me about my case....still in its "Initial Review" I asked them how long it takes to process the case, the lady doesn't know and told me to use INFOPASS to make an appointment. That's what I did. I got an appointment to talk with the Immigration Officer near my are in 2 days from now.

Is there anything else I should be doing? On the appointment date should I bring anything else beside ID and appointment letter?
