that's great, same as me. we didnt have kids, i'll make sure will include it in my personal letter about our marriage. i kind of getting nervous seeing you get RFE. as you saw my post of my list of evidence, i dont know if it's good enough. i'm only 22 and my husband is turning 31, we dont have anything together, no cars, no house and living with his mom. he is kinda guy lives day by day while i'm going to school and work full time and wants a decent life. that's one of the reasons leads to the divorce. on top of that he admitted that he cheated on me while he went on the trip to his country the july just passed, i dont have evidence and he wouldnt admit it on paper so all i can do is writing it on my personal letter.

is that everything you ave sent them in the packet? i think affidavits is good when it comes to waiver case and pictures can become handy :)

That's everything I sent in addition to the other documents about me like

My tax transcript showing that I make a lot of money and can more than take care of myself and will never be a burden to the Government because I'm divorced.

School transcripts and ID cards showing that I'm currently pursuing a career.

I also sent a copy of my DL showing the address I shared with my ex husband.

Finally the personal letter explaining how we met, events that led up to marriage and divorce.

My husband pretty much quit his job shortly after we got married. Because of that, I had to work 2 jobs in addition to going to school full time so that we could still pay the bills. He started complaining about me working too much and then the argument started. He has a loud voice and I think he tried to scare me with that but he knows I wasn't afraid of him. To prevent my name being in a police report and him going to jail, I slept on my cousin's couch just to give him some space. I suggest marriage counselling ( he said hell no).

A few weeks later, I started getting phone calls from a lady telling me to leave her boyfriend.. Ha. I bet she wouldn't tell me that to my face. I ignored her but she would not stop calling and texting me( I saved all the messages). I mean this lady has never met yet she was calling me all the names in the book. I told her I would file a police report because she was harassing and that's when she stopped. I tried everything to work on my marriage but I have up when I found out that the girl was pregnant. The divorce was filed instantly. At the final hearing, the judge said it was the easiest divorce he's ever seen because it was jointly and I need absolutely nothing from him. He didn't even show up to the divorce hearing. That was great because the judge treated me so well and I was in and out in 15 mins.

After no communication and not showing up at the hearing. My ex husband decides to call me 2 months after the divorce was finalized to apologize for everything and wanted to get back together. He also told me he has a new baby and that the baby's middle name is my first name( which is actually true). I was so hurt and had only 2 choice ( state of depression or finishing school and look towards a better future) I chose the latter.

My letter was very emotional and strong and I wouldn't mind getting interviewed to go in details about everything that happened throughout my 2 years of being married...

Yes a RFE is definitely not bad! They want to approve it but want more info. Make sure you send a very detailed personal statement of EVERYTHING (how you met, the courtship, what happened, how it made you feel etc) Be very detailed and hold nothing back. I did a ROC waiver (that was approved) also and my personal statement had 40 pages. I'm not saying yours should be as long as mine at all, but it should have a good 15 pages and span the entire duration of the relationship to the point of its demise. Also, organize all your proof of Bona Fide very clearly and feel free to point out information. For instance, I wrote notes on the back of every pictures about where it was and what happened that day etc. I also circled and highlighted our rent going through on our joint checking account list of transactions etc. Be sure they know he fathered a child with someone else! That's terrible! But it is grounds for divorce. I'm sorry you had to go through that. It will get better though :)

Thank you so much. Do you think I should send the personal letter again? I really didn't go in details because it would probably be a book. I might do that though. I have a lot of pictures but didn't send any. I will included those as well.

I think I will spend a day or 2 and put together a nice file. How long ago was your divorce?

Aww, i'm sorry to hear all the things you had to go through. But think about it in positive way. what would happened if you're still with him til this day, all you get will only pain. i was scared too. when i met him, my family didnt approve because he doesnt have a stable career, he has nothing and still living with his mom. but he was the only and first guy ive ever been with. my family is a very educated family. on top of that because i was exchange student my cousin and my auntie are my sponsor in this country. so they took relly good care of me since my mom doesn't live here. they were pretty strict they wanted me to go to school and be success. i put aside what they had to say. and moved in with him when i was 19. i was so scared to get divorce. i didnt know where and who to turn to when the whole time i thought my husband will never betray me. i was so ashamed of myself to talk to my family. they didn't blame me or said anything to make me feel bad. they opened their arms to support and protect me. it really encourage me to be able to move on with my life. i just want to be able to live my life. go to school work, pursue a career and have a great job, travel which he always said no to. i feel much relieved because i know it would be just a incomplete life if i stay with him.

Also, make sure your bona fide evidence spans the entire marriage, like, not just one checking account statement, but statements from every month of the marriage. Show them you are well prepared and give me detailed and varied prof when you send back your RFE response and most likely you will not have an interview.

Ok. Thank you. The bank account was closed but I called the bank and they said I can come in and get monthly statements which is great. I also called the utility company and my name is still on the bills till this day. I will dig up everything I can...:)

Yes! Dig up everything you can! When you were married with someone, there is a lot of proof of joint life. Check your credit report, you'll probably find your husband on there. Credit companies somehow find out you are married and he'll be listed under "associated persons". Also, you can print out your phone statements over the months, print them out and highlights all the texts you sent each other.

Update: today I received a letter stating that my I-751 petition has been denied and my residence status terminated. The reason being because I was unable to provide a divorce decree, I am waiting for the final judgement to be signed by a judge. The letter states I will have a court hearing with an Immigration Judge and I am to turn in my GC to my local office. Obviously I am worried beyond belief, I just started a new job last week and now I might lose it all, don't know what to do or say right now.

Sunshine, try not to worry, you have this covered once your divorce decree comes along. I know not worrying is a lot easier said than done, but try to get on with your life for now.

Im permanently worried in the back of my mind about my ROC too but im trying to ignore it. Im expecting an RFE because my divorce decree has things blacked out and at my biometrics appointment they accused me of altering it. Ive since had the county clerk stamp every page and write a letter explaining that the judge did it, not me. So im just awaiting the RFE so i can send it to them. Still really worried though because she also said i was wrong in getting married in the UK and divorced in the US. I came here on a CR1, NOT a K1 so i can marry or divorce wherever i like. Im thinking she maybe mistook me for a K1 that married prior to coming to the US. Still worries me though with what she said.

Thank you! In California divorce takes at least 6 months, more when children are involved. In my case I share one with my ex-husband and we did have to revise our agreement a couple of times in order to have a visitation schedule we both agreed on. That definitely added time to the already lengthy process :/ I want to refile before I receive the notice to appear, if it's possible but the lawyer I spoke to said it's not an option. I will meet with another lawyer to get a second opinion and contact the court to inquire about my final judgement, hopefully I call enough to get them to listen and take action!!!

I had a detailed cover page listing all the evidence they requested and my reason for not having majority of them (lease, bankstatement...etc)

I took your advice and spill evey single details about my marriage. I put alot of effort into it (highlighting things that i want them to see). I had a detailed cover page listing all the evidence they requested and my reason for not having majority of them (lease, bankstatement...etc)

Thanks to everyone else for the support and the words of encouragement and always believe that "Everything in life happens for a reason".

My petition for Removal of Condition with a divorce waiver was approved on 10/29/2014. I added my name and date to the timelines. Good luck to all! I didn't get any RFE or interviews. It took les than 3 months from application to approval. I divorced on July 29, got my General Dissolution of Marriage the same day (In my state you can divorce and get your dissolution the same day, yay!) and sent my package on August 4th.

If anybody has a question about my experience, please let me know. For many people is scary to think that because you divorce you will have lots of trouble to keep your residence or to lose it. Fortunately, if you enter your marriage in good faith and you have the necessary documents, you will have no problem keeping it!!
