I-751 Waiver Filers Timeline

It doesn't matter who files for the divorce. My ex husband and I agreed with everything so my divorce petition was jointly. As long as the marriage was entered in good faith, that's the only thing that matters. I think the idea to have his mom write a letter stating the living situation is a good thing. I'm also a divorce waiver. It's been 3 months since I filed and I haven't received any RFE yet. I didn't sign a lease with my ex husband but we had bills showing that we shared the same address.

I will keep you posted.

When does your conditional residency expires? Please know that you will have to file the I-751 divorce waiver before your greencard expires even if your divorce is not final.

that's great! then we will file for divorce petition jointly. do you think that i should send in my ROC package the mails send to him show the address, and also mails to me with the same address? my green card is expired in December 11. and thank you so much for you your advise. i will keep that in mind; hopefully that i will get my divorce finalized as soon as possible. my package will be mailing to Vermont.

I don't think that random mails with the same address is important. The documents that I had with same address and jointly are:

Tax return

Light bill

Health insurance

Dental insurance

Life insurance

Auto insurance

We didn't have joint bank accounts and a lease and I just explained the reason why in the letter.

hi everybody, i have some questions toward my i-751 petition. please help me if you can. thank you

- i got my 2 years green card and the address was at my ex-husband address( we are getting divorce). where do i start to change the address and so all the i-751 application letter will come to the new address? i saw looked online but i'm not sure where to start, please help.

- for the i-751 form, Part 1- #22: it asked if i have resided at any other address since i became resident. which is i have, like i said above that we are getting divorce, so now i moved out. do i need to list the old address of my ex-husband address? if so. i just need to write it a piece of paper and attach it with the application?

- Part 3 it asked to fill out information of u.s citizen that i gained my green card through, which is my ex-husband, is that correct?

- Part 4 is list all information about the children, we don't have any kids, so should i just leave it blank or i should write none?

- Lastly is part 7, since i prepare the i-751 application myself, should i just leave it blank?

Thank You So Much For Your Respond. :)

1. Fill out I-751 with your new address and everything from USCIS will come to that address.

2. Yes, you should list the old address since that's where you lived since becoming a PR. Write on a separate paper and attach it to the form.

3. Part 3 is correct

4. Part 4 is correct

5. Part 7 is correct.

I received a RFE in the mail today. They are requesting everything I already sent in ( what a way to buy time.lol)

My online status is still in initial review stage..

I'm getting everything together now and I will definitely make sure that I highlight everything they asked for.

I'll mail it back today so we'll see how long it will take them to either approve me or give me an interview date.

Sorry to hear that Newbie, But you should be glad that its good that you heard from them only after over a month you got biometrics. i've seen people got their RFE after 3 or 4 months and then waited for so long for them to process again.

do you mind to share the list of evidence that you sent?

and how are you going to send in the RFE if what you sent is all you have?

good luck prepare the documents :)

Yeah I will consider myself lucky to hear from them..?. I sent the following joint documents

Tax transcript

Auto insurance

Health insurance

Dental insurance

Life insurance

Light bill

I think this RFE is a standard one because they are asking for birth certificate of children ( we don't have any)and the above documents that were already submitted. They also asked for a lease, mortgage and bank statement which I don't have so I will just explain the reason for not having any of those...:)

Filed: Timeline

Dear Newbie, a RFE is actually a good thing! it means they are trying to approve your case without an interview. Most people send in their RFE and are approved shortly after. It will be fine :)

ROC Journey:

sent in I-751: November 2013

Biometrics:December 2013

Card production text & email : August 2014...No RFE, no Interview :)

Now a US citizen...

that's great, same as me. we didnt have kids, i'll make sure will include it in my personal letter about our marriage. i kind of getting nervous seeing you get RFE. as you saw my post of my list of evidence, i dont know if it's good enough. i'm only 22 and my husband is turning 31, we dont have anything together, no cars, no house and living with his mom. he is kinda guy lives day by day while i'm going to school and work full time and wants a decent life. that's one of the reasons leads to the divorce. on top of that he admitted that he cheated on me while he went on the trip to his country the july just passed, i dont have evidence and he wouldnt admit it on paper so all i can do is writing it on my personal letter.

is that everything you ave sent them in the packet? i think affidavits is good when it comes to waiver case and pictures can become handy :)
