Thanks all of you for your support. I wana say that dont worry and pray to Allah, He will give you success. I remember @ my interview I was praying and my attorny who was siiting next to me asked me that if I am talking to my self I said I am praying.

Once again Good luck to all who are still waiting for their cases.

When you got the interview notice, did it change the case update date in your Account? the last time we all saw a change was 06/26.

my attorney recived notice for my interview last week he called me for that. the notice was issued on 11 july.my status online has not been changed yet every thing is same. last time wes touched@ 6/26/10.

I am So happy I can not describe in the words after my Green card approvel. In last few weeks I was praying to my Allah all the time, and finaly I got good news.

I spend very hard time in last two years, and about three months before I have decided to go back to my home country. coz I was fedup with my life here with terminate status.

My advice for all those who are waiting, Have faith and pray to Allah. He will resolve all of your problems.

May Allah Give all of you Power of Iman.

I filed for removing of conditions on my GC through a lawyer under good faith marriage waiver. i am done with my biometrics and just waiting for an answer from USCIS. I am pretty hopeful that I will be granted my permanent green card because i have a very good case and documentation.

1. In case God forbid that they deny my case, my employer is ready to sponsor my GC under employment based green card. I am eligible under EB-3? what should be my next course of action?

2. Considering the scenario above actually happens, what would be my travelling document?

The process for GC sponsorship through an employer is so long it's easier and faster to go through the hoops of MTR (Motion To Reopen) and appeals for your I-751 denial (God Forbid). Have faith in God and don't worry. You may thing you don't have enough evidence, but in case of a denial and appearing infront of an immigration judge, USCIS will have the burden of evidence to show that your marriage was a fraud. And that's not easy. Trust me, if you marriage is real, you shouldn't worry a bit. And cheer up :) I was in your exact same shoes and i got approved in less than 3 months, Praise God.

I've been thinking along similar lines in the past couple of weeks. I filed in May, still haven't heard anything (other than a letter responding to my service request, saying "yeah, well, you'll hear from us"). I have no choice but to travel abroad in October and here's what I'm wondering:

1- If they're not done adjucating the case by the time I travel, do I need to take my NOA1 as an extension (although my GC is valid until next year, but I don't know if filing the I-751 early kind of "invalidates" it)? Should I take the marriage certificate? My spouse's death certificate? Or proof of our relationship even, for the officers at the POE?

2- If they ARE done by the time I travel but I haven't received the actual new card yet, can I still use the old card to get back in? I don't want them denying me entry based on their system saying that I got a new card and the old one can't be used anymore.

3- If they decide the case WHILE I'm abroad, and it is denied, do I get reentry? Or would you have to file MTR from abroad?

Sorry, guys, but when you don't hear from them about your case, your mind goes crazy. Well, you all know what it's like. Your input is heartily appreciated! :)

Plus, I still don't have a biometrics appointment and can't seem to find out if they're requiring me to get one or not (since my last one is less than 16 months old.)

I don't want to ASK for a bio appointment through a service request and then have it done although the adjucating officer wouldn't have required one anyway (thus me causing a delay in my case by getting the bio appt even though unnecessary).

On the other hand, I don't want to wait forever and down the road find out that I should have requested a biometrics service request now because the officer wants them (and therefore having a delay by simply waiting long to put the service request in). Did that make sense to anyone? I'm sorry.....

i had to call too for my biometrics..and 2 weeks later i got my appointment..so dont worry

u can travel with ur greencard because its not expired u can still use it..the noa is just for the people which have the issue that the 751 needs longer then 3 month...if they call u in for an interview u recieve the letter usually 1-2 month after bio..but i have doubts that u will get called in....

Timeline

1- Yes, been there done that. Traveling with your NOA1 and GC (expired or not) is exactly what you should do. I entered the US in March with NOA1 and my EXPIRED card without any problems (praise God!). I actually don't think you need your NOA1 since your card isn't expired, but it certainly won't hurt to bring it. The NOA1 is pretty much an extension notice that serves as a proof of continuing permanent resident status for those with an expired card.

2- See my answer for question 1. They won't deny entry simply because your new card hasn't made it yet, and your NOA expires in May 2011. Will you still be outside the US by then?

3- I'm not 100% sure, but I'm almost certain they give you the right to appear in front of an immigration judge. I honestly haven't ever heard of an i-751 waiver due to death of spouse being denied. Please think positively, since this is the best cure to the waiting process.

If i were you, I'd schedule an infopass and ask if a biometrics notice has been sent at all. I know of a japanese immigrant (also applying for I751 waiver) who was questioned during her entry to the US because she was supposed to appear for a biometrics appointment even though she never got the notice in the mail. They let her in, no worries. Apparently it's your responsibility to appear for biometrics even if you never know about it. So ask them if they've sent you one. I wanna say they don't need your fingerprints again, but ask, just to be on the safe side.

P.S october is still 2 months away :) too early to worry.

Thank you for your response. I really appreciate it. By Allah, everything is fair and true in my case. Its just that I imagine a best case and a worst case scenario in everything I do. And i was just imagining a worst case scenario.

Too early to predict anything. I will just cross my fingers and wait.

You should wait to cross that bridge when you and if you get to it.

I am sure your lawyer dotted the "i"s and crossed the "t"s, and especially when you feel you have solid evidence, that should be enough to get you approved. USCIS will not deny people if a good case is presented and a good-faith marriage has been established.

I am not sure what happens to get sponsorship from an employer, but let's hope you don't need to find out.

Traveling outside the US, you will have to use your home country's passport and to enter the US you will present your GC (and the extension letter if asked for).

Keep up the positive attitude and you will soon hear from them.
