This question is directed to people who have filed a K3/K4 and successfuly completed the adjustment of status process. I am getting ready to file an I-485 for my wife and her child. Maybe I'm reading it wrong but when I was reading the instructions for the I-485 it seemed to infer that a seperate I-130 was needed for the derivative (K4) child. Is this true? I know I need a seperate I-485 for the child but a seperate I-130?

Yes... an I-130 is needed for a K-4 adjustee.... prepare it and submit it together with the K-4's I-485. You will need to pay the I-485 & I-130 fee

My wife and her child are here on a K3/K4 visa. I am getting ready to file an I-485 for my wife and her daughter. In reading the instructions for the I-485 it seems to infer that a seperate I-130 needs to be filed for the child (derivative). Is this true? I know I need to file a seperate I-485 for the child but a seperate I-130? I would appreciate replies from people who have successfuly completed the AOS process from a K3/K4 visa. Thanks

Answer remains the same... YES... the K-4 adjustee requires a separate I-130 for themselves. I-130 fee is also needed to be paid in addition to the I-485 fee
