i cant wait to be home in TEXAS with hubby

we are going to Tyler texas

now this week just getting all documents to prove TIES to CANADA

so if anyone has thoughts on that let me know

just praying we make it across border

being with hubby makes this LONG wait a bit easier if SUCH a thing

I don't understand why you need to prove ties to Canada. Aren't you Canadian citizen? If you are, crossing the border should be easy. I crossed the border many times (between BC and Washington) while this immigration process is pending. I even crossed together with my husband and we told the officer we have an immigration process pending and he still let me pass. As long as you don't have many luggages with you that makes them suspicious you won't come back, they should let you cross. Just tell them you go for a trip.

Have you called NVC to check if it has proceeded through there? The I-129F petition goes from the service centre to NVC then to the consulate.

Because the rule of thumb for the CBP officers is that they MUST assume that someone that wants to cross is not going to return unless they can prove otherwise to that officers satisfaction, and there is no hard and fast rule as to what is enough proof from officer to officer.

So would having a husband in the US while your place of residence is not in the US, to most officers this sets off alarm bells that this person has a strong reason to stay in the US and NOT return.

Making sure she has ties to Canada, to show she has reasons to return beyond "I was born there" will help the decision that she can cross if she is questioned or if there are doubts.

Many of us have gone through to visit our loved ones with pretty well no questions asked, many of us have been questioned heavily...some of us have been pulled into secondary because we didnt convince the first officer of our intent, and a few of us have been turned back and not allowed to cross at all.

Its best to go prepared, especially when you are planning a nice holiday.

You're right. It's best to be prepared. I guess I was lucky so far and maybe the fact that I live in a border town where it's common to cross very often helps too.

Even though I live on a border town, I always carried copies of my deed to my house, or when I sold the lease agreement to my apartment, some copies of my utilitie bills and also a copy or so of the kids reports to the school also my employer gave me a letter stating that I worked there and continue to work there. Also, just to make sure I carried my divorce judgement papers to prove I had sole custody. I know this was over kill but I did not want to have anything to stop me, It did not take much to photocopy and keep in my glove box because before the interview and I had to forfeit our passports, I crossed the border everyweekend. (that is one of the reasons why I am having a hard time with the wait thing) so to be on teh safe side I would just have copies of something to show that you have to come back.

Last week I talked to a lady at DOS and she informed me that montreal is backlogged because they had a staff shortage BUT she also said that they resolved that issue a few weeks ago...don't know if thats true or not because I didnt find anywhere on VJ that someone heard back...anyone?

Last week I talked to a lady at DOS and she informed me that montreal is backlogged because they had a staff shortage BUT she also said that they resolved that issue a few weeks ago...don't know if thats true or not because I didnt find anywhere on VJ that someone heard back...anyone?

Hi Everyone,

Our K1 Visa process has been pretty quick since August of 2009, with interview on March 24th, 2010. At the interview however stating in my documents that I had a summary conviction in 2000 put few flags which the officer asked for documents notarized by lawyer or court stating the criminal code, that it was a summary conviction and $5000 over or under, 6 months more or less. Since we got quite the amount of experience in this department, knows ins and out. Providing a lawyers letter with explanation which was sent to the Embassy in Montreal in March 30th received by them on March 30 (even though the consular officer looked at my copy of probation order from the court, she still couldn't figure out if it was a summary even thought court states that an (s) placed within the conviction note on the probation order means SUMMARILY CONVICTION) seems to put us in AP status which is fine, however with the backlog they had or are having still not sure no one telling us nothing, we've been waiting;

11 weeks past this Tuesday.

Hopefully soon they make their decision of some sort. I've got twin girls on the way, fiancee is 31 weeks pregnant. I hope, hope and hope I can be there. Court, Canadian Government officials, Police, you name it, I've called, wrote a letter, asked etc... no one has or can provide me with any information on my case or court documents. We will see, hope that everyone else has their papers together for the interview, missing even a single form or proof is terrible believe me. I wonder why everyone in Canada and at the US border when I talk to them can't believe this is happening to us, that this is something that is so small and so stupid to be going through. Yes CBP, chief and all, stated himself that it doesn't seem like a biggy but after all conviction is a conviction and without proper documentation I can't go to US. :(

Good luck everyone, I'll keep you posted on my stuff and I hope no one on here from Canada to US has to wait this long. If it takes 11 + weeks for the embassy to tell me that the document I sent to them with my passport is not enough, NICE took 11+ week for them to tell me that, I could of spent that time doing my waiver or something which takes time of its own. BTW congress did zippo, but been yelled by the embassy, immigration lawyer did zippo too, he actually isn't answering us even though we paid him in the first place. DOS only states its in AP status that is it.

Since admitting to US about my past, I've lost travel on my vacations, can't even travel for business anymore which made the possibility of expanding my business not only in Canada but US thin air now. Also my twin girls will never bond with their dad since I won't see them who knows when.

I guess its my luck in life, always has been like that. Hope I get better luck in my 30's. Sorry if I sound fed up or mean about the embassy, cbp or others, I'm just tired of the wait and discouragement week by week hoping this is it.

i feel the pain and stress it causes

you not alone

i waited a year and 3 months just for interview and got temp denied

submitted required documents and been waiting another 7 weeks

lucky i applied for enhanced drivers and id for myself and children

so we going to usa next week for summer....

just now to pray we get across

it really heartbreaking and very hard on children and such so much for the REUNITING FAMILIES

Hi everyone,

UPDATE: Got a message from Canadapost that something is being shipped to my husband from Montreal but dont know if its his visa or just his passport. I called DOS but they are not open????!! I had sent an email to montreal asking what the procedure was for passport return but i didnt mention case number or anything of that sort in the email...now im just biting my fingernails...there is no way for me to find out until DOS opens!!!

Also, if they just return your passport without a visa, for ex. because of a refusal, do they send it in the envelope you provide them?

Just called my senator's office and they said they got a letter saying that my husband's visa is APPROVED!!!! and its in the mail and he should receive it in 7 days!!!!!!!!!!!

The DOS closes for an hour or two wednesday around lunch so that might be why you can't get through.
