missing documents.

Timeline

I filed 2 forms, 1-130 for my spouse (married 2/12/10), and one for her son (under 18). I failed to send the required $355 for each petition. The son's I-130 was denied and sent back to me. I promptly paid the $355 for the additional petition. I have a few questions.

I did not send pictures to prove bonifide relationship. I did however send 2 sworn statements, one from her mother and one from her sister who were both present at the wedding. Those sworn statements were returned to me with the son's I-130 petition denial, with no explanation. I did send a marriage certificate with the initial petition.

I did not send a birth certificate for her son, but now as I read more and more, I'm finding all these things that may be missing which will in my opinion generate and RFE.

Should I send these documents in now? or should I wait for the RFE's to come in. We are just a little over 2 months from NOA-1. Any suggestions?

I-130 NOA 1: 03/21/2010

RFE : NONE

I-130 NOA 2 : 7/19/2010 (no touch's, no emails, no text notifications) Received Hard copy in mail 7/26 2010.

NVC Received : 8/02/2010

AOS Bill : 8/03/2010 ( Received Via Email after calling on 8/2/2010 )

Paid AOS Bill : 8/04/2010 ( Paid Invoice electronically )

AOS shown as paid : 8/05/2010

Mailed DS-3032 : 8/05/2010

Mailed I-864 pkg : 8/06/2010

NVC Receive i-864 : 8/09/2010

NVC Receive DS-3032 : 8/09/2010

IV Bill (available for pay): 8/20/2010

IV Bill Paid : 8/20/2010

IV Bill Shows Paid! : 8/23/2010 (just waitin for the docs from my wife now) should be here next week!

IV Package Sent Finally: 9/04/2010 (due to arrive 9/7)

Received checklist : 9/06/2010 (they are looking for the IV package) hmmm, ummm, I KNOW! So was I!

IV Package on AVR : 9/10/2010

Received Checklist 9/28/2010 (said PCC not in correct format)

Case Complete 10/13/2010 ( have not received replacement PCC from wife yet to send into NVC, How can this be?) I'm not complaining!

Interview 11/08/2010

PS As of 9/11/2010, USCIS website still not updated, shows NOA-1 date and... blah blah blah. don't count on them folks.

Did you send in the check already? If you did, there is no point to send the other documents now. They could get lost because they weren't all sent in at once. The RFE for the documents would be your best bet for right now.

Someone can correct me if I'm wrong, but I have read this time and again on here.

-E-mailed SUE to see if that would do anything (3 diff times...): 11/29/30/10

-Sent AOS RFE's: 12/1/10

-AOS RFE's received: 12/2/10

-Checked payment portal for fun (SIF!!!!): 12/3/10

-AVR still say AOS missing info: 12/3/10

-NVC operator says case was shipped to USE in Lima: 12/3/10

-Received interview date (12/13/10): JANUARY 6th, 2011!!

-Medical: 12/21/10- Passed :)

-Interivew: 1/6/11- PASSED :D

-Visa received- 1/13/11

-POE FLL- 1/23/11 YES! BUTTTTTTT....still not reunited :'( (Reunited on the 24th)

That's right. You need to wait for the RFE to see exactly what is missing or wrong. Then submit all of the needed evidence with your RFE response. If you send it now, it will likely not be matched up with your current file. Also, you may find that the letter requests something you had not thought of yet and you would have to mail yet another package.

But will it really hurt to send them in? I sent in a letter requesting that may address be changed and they quickly matched it up. I don't see how it would hurt to send them in, even if it may not get matched up. I would not send original pictures though...print them on a piece of paper, like 6 to each paper.
