Hi,

at the point 25 it asks whether the sponsor has filed taxes in the last three years. My wife filed taxes only in 3 years ago but not in the last two years since she was a student. Should we tick that anyway?

12/16/2009 - USCIS office received the form

02/16/2010 - NOA1

02/22/2010 - I-130 Approved

05/27/2010 - DS-230 sent

If I understand correctly, you're saying that your wife filed taxes in 2007 but not 2008 and 2009? Is that is the case, you should not check the box.

Question 25 states: I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only themost recent tax year.

This would not apply to your wife since she did not file taxes in 2008 and 2009.

However, I would still include copies (or transcripts) of the year she filed.

Well... she was a student and before that she has been one year unemployed after relocating to Italy.

Ok, so for the year that she was unemployed just attach a letter explaining that she was unemployed and so she didn't make any income. For the year when she was a student, write that down, and if possible, attach evidence for that (such as a registration letter or similar). Not sure if there's any written proof of unemployment that she can get from Italy - if she can, include that. If not, no worries, no big deal.

Re the most recent tax year: if your interview is before April 2011 then the 2009 tax returns will suffice as the most recent. If it's after April 2011 (rather unlikely looking at your timeline) then you'd need the 2010 tax return as your most recent one.

Thanks a lot! I faxed my docs and waiting for the embassy to reply. I expect an interview around mid july at the latest! :)
