I was able to get some info on my case today and was told i have been in Security Checks for sometime now.

I know it is standard for security checks but the comment im concerned with is "For sometime Now"

So that means a name hit??

Any advice or comments to what this really means in "TimeFrames' of how long you can be held up?

Thanks~Kelle

I only offer advice - not even legal. Just the plain and simple kind.

It seems that from the new IMBRA law, USCIS can also search into the criminal background of petitioners as well. I'm not sure if this would fall under the "administrative processing" though.

Check the publication date of that article -- if it is before March 2006, then all those would apply just to the beneficiary.

Hi Kelle

This exact same thing happened to me as well, I was in security checks for about six months, it took them 189 days to approve my visa. I just kept emailing them and contacting USCIS letting know that I am still here and I was not going to let them forget it. And of course they kept telling me the same thing "security checks" I contacted my Congresswoman, and they gave her the same answer as well, so really all you can do is wait it out. I don't think it ususally takes more than 6 months or so. I think there are a few on here that have been held up for up to 9 months or more, but if I were you I would just pray for the best and hope for the best, keep bugging them, and try to have patience. I know it is very hard though, you are in my thoughs and prayers for a speedy approval. All the best of luck to you!!!!

Glad you guys made it through. Sigh.. CSC doesn't even allow e-mails from the "general public" anymore... so it's probably best just to call every couple weeks to once a month.

Name/security checks are conducted on the foreign fiance/spouse & the USC petitioner at USCIS service centers. They can also be conducted on an attorney or anyone to do with the petition. This was even pre IMBRA. Name/security checks are also done at NVC & consulates. The length of time it takes can vary greatly but the majority of them are cleared up relatively quickly.

Kelle

Yes it seems there was a name hit. Until they determine that the name hit is false it will not be cleared. This could be either yours or your fiances. There can be security checks on other issues too such as country of origin, certain occupations etc. Hopefully you hear something soon. The lengthier timeframes in being held up seem to generally occur when they are country, occupation related.

tis April 25th 2006,

probably why there is no direct reference to Petitioner or beneficairy.. just " applicants" guess that now includes both sides..

"All applicants for a U.S. immigration benefit are

subject to criminal and national security background

checks to ensure they are eligible for that benefit.

AT USCIS level does that make the USC the applicant?

U.S. Citizenship and Immigration Services (USCIS), the

Federal agency that oversees immigration benefits,

performs checks on every applicant, regardless of

ethnicity, national origin or religion. "

now they appear to be talking about the beneficiary...

Kelle's post said that " and was told i have been in Security Checks for sometime now." Im not sure if she means herself as the USC, or the " I' is referring to her petition.

oh well it will make sense eventually..

I will stretch it here, with my extensive overseas and domestic tours of Government experience.

I frequently ran name checks, several hundred during that particular tour, yet we released our results within days.

Overall, It is not a simple process.

Many agencies involved and an arduous process.

Security checks: that would be Department of State, FBI , DEA, Secret Service and CIA indices. Hold on for the ride, one of you two was a "hit" name wise.

It takes time for the transfer between agencies.

Don't worry, you will be cleared, eventually. Surmising that there are no issues.

It does take a bit of time, but they need to clear everything first.

Hang in there!!!

Yeah Icey i heard that they would not allow any emails anymore, that really stinks, I don't know what I would have done if I could not have emailed during that long wait. But, I guess she can just call and call and call. When I said our visa was approved , I meant the petition, now we are NVC, and they are holding our petition there now too, so I don't know how long it will be held there, it has already been there a month, so we will see....Good luck to everyone, wishing everyone the best of luck
