There is nothing wrong, or illegal about him remaining in the US and adjusting status since the intent to marry and remain in the US was not there when he entered the US. Also, Christi85, the K3 is dead - USCIS has nothing to do with it. It is closed by NVC, but when it was alive, you never entered from a K3 and switched to a CR-1 once inside the states. Christi85 - begin reading about all the visa types and what happends when you enter the US so you are prepared to help others.

The K3 visa is explicitly mentioned as you can see, as is USCIS on the first link, so I'm not trying to mislead anyone on purpose here. I will take your word that the K3 has ceased to exist and will "blame" the Consulate's website for not being up-to-date if this is the case :blush:

Also, this is a direct copy-paste from an immigration attorney's website, and I've read this elsewhere too:

"The rest of the K3 spousal petition is similar to a K1 fiancee visa process. The K3 spouse files for adjustment of status after entering the U.S., however has 2 years in which to do so. (The visa is a 2-year multiple re-entry visa)."

On a different note, I'm feeling particularly hurt by the aggressiveness my comments have raised on this post, which was totally unexpected.I joined this forum very recently trying to find more info myself about this daunting procedure called immigration and have loved the info I've been getting. I really don't feel this strictness is deserved and I certainly don't feel particularly welcome in the forum right now, thus I'm going to refrain from posting comments on other posts as much as I can since I'm not suitable to help, and will only post my own questions as and when needed.

One last thing: I did re-read my first post and I DID stupidly say "adjustment of status to CR-1" when I meant to say adjusting status to get a green card (obviously - if you are in the US!!). That was a slip of the tongue :blush: .

I came here on a tourist 6 month visa to see my girlfriend and meet her family (I'm a British citizen living in Greece for the last 7 years) and had all intension of going back to Greece. My visa expires on 6th June. 30 days ago I proposed to my girlfriend and on 22 may we were married.

The question is what do I do now. what forms do I need to fill out so that I'm able to stay here. I want to do everything by the book, I'm so scared and confused that I may go about this the wrong way and be separated from my wife. I'm quite happy to become a US citizan as long as I'm with her.

If you could advice me or send me a link that would be such a help

Hi, jedinight. I agree with the VJers that advice you to file for the AOS, but there's a catch. Someone correct me if I am wrong here, but if you let your I-94 expire, USCIS begins proceedings for your removal. This takes some time, so, you should still be able to beat the clock if you send all the necessary forms in in the next couple of days. Also, as someone already said, it is ESSENTIAL that your wife can prove economic solvency in order for everything to go smoothly.

I also entered on a tourist visa, I have a border crossing card, which is issued to Mexican citizens living in border states. But, since I've had a visa since age 11 because of this (had to renew twice already), and I married my wife almost 3 months ago, there is clearly no fraud intended. Heck, we were going to do the consular filing, but couldn't be apart for so long. As pointed out already, the only reason why you wouldn't be able to go ahead with the AOS is because there is evidence that you came here with the intent of getting married, or better put, you got your visitor visa because you wanted to come here and get married. Sad as it sounds, there's people that do this...

Oh, and Christi, don't take it personal. We are all on the same boat here :D

Uh, Mustafa... I read your posts, and it seems to me that you are on your own with this one. I think I speak for many when I politely ask you to stop linking or pointing to your posts because someone closed the topic, just so you can try to get someone to see your way. Truth is, as many of us have said before, and I'm sure some already got their GC this way, it is legal to file for LPR on a tourist/visitor visa IF there was no intent to get married or immigrate when you first filed for it.

Not to mention that all this misinformation confuses feloow posters, who happen to have a lot going in their mind to finally get to be with their loved ones. Relax my friend, and I wish you well on your process.

Christi85 - nothing in my post was aggressive, I'm sorry if you took it that way. There were some misleading comments that you, yourself, admit you made. I was simply suggesting you read up on procedures (since you are DCFing and it is a whole different process) so you can help others.

The links you provide are correct. The K-3 is alive and well for those who had approved petitions before February 1, 2010. This this is not the OP, the K-3 is dead to him.

Just for future reference, that is not true. USCIS has other things on their plate then looking for tourists who have overstayed their welcome. They are pretty busy trying to retain and deport criminals.

This is why I always say "get a lawyer" because while it is true some couples have success different circuits have different rules, as you can see in the article.

"In the Third Circuit, Citizenship and Immigration Services will no longer approve green cards based on marriage if the application is made more than 90 days after the foreign spouse entered on a visa waiver, officials said."
