Serious Affidavit of Support questions! Help Please!

I'm about to get the AOS ready, my sister is gonna be the co-sponsor for my husband.

I work as a nanny, but I dont have a bank account or tax returns, my sister does though.

Do I have to file an AOS too without tax returns or Is it just ok if I send the AOS of my sister (co-sponsor) only??? and what are the papers she would need besides tax returns??

please I need help, I dont wanna mess this up.

You need to file a I-864 too, as you are always the primary sponsor of your spouse. You will need to include a letter explaining why you were not required to file tax returns (ie income too low).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

how low an income can get for them to not questioning why your taxes report didnt come with the AOS?

and what are the papers that the co-sponsor should give besides tax returns?

Your income must be below poverty line according to IRS guideline. If you're single and less than 65 years of age and you only earned $9,350, you don't have to file taxes. But it is generally a good idea to file your taxes even if you make $1,000. You can look forward to rebates, credits, and whole slew of other benefits. Plus, filling taxes are your civic duties. Moreover when things like immigration comes around, you won't have to log into Visa Journey and ask "serious questions about AOS."

So in future, file your taxes diligently.

The joint sponsor files an I-864a only if they live in the same household as the sponsor. It is not clear the OP and her sister are part of the same household. If they are not, the sister files an I-864, not I-864a.

The joint sponsor files an I-864a only if they live in the same household as the sponsor. It is not clear the OP and her sister are part of the same household. If they are not, the sister files an I-864, not I-864a.

yes the sister lives in the same household as the petitioner (me). that means i should file I-864 while my sis files I-864a! I hope Im getting this straight!

The letter is ok, however you can't state the figure of 9,350, that ladynthetramp quoted, as this does not apply to all years.

What you need to do is look up the previous years 1040 instructions for 2007. 2008 and 2009.

The previous years forms are here.

So for instance, for 2007, if you filed married filing separately, the cut off amount (see page 6 of the instructions) was 3,400. If you were not married in 2007, then look at the cutoff for filing single, that amount in 2007 was 8,750.

You need to:

1. Look at the 1040 instructions for each year

2. Find the status that would apply to you for that year (single, married filing separately etc)

3. Find the cut-off figure

4. Include that in your letter

So it might read something like this:

I did not file taxes for the past 3 years as my gross income was less than the cut-off figure for filing:

2007 (single) 8,750

2008 (married filing separately) $amount

2009 (married filing separately) $amount

All the above answers imply that she was receiving a W-2 for being a nanny and is not considered self-employed. The threshold for self employment is much much lower, not because of income tax but is self employment tax (which is social security tax). But I don't know if the USCIS cares about that, but the IRS does. My opinion, see a tax professional.

Sorry, above should say "not because of income tax but because OF self-employment tax"
