My dad is going to be my co-sponsor and I have a couple of questions about the I 864. Would line 23 "current individual income" be my dad's personal income or my parent's joint income, since they filed a joint return. Likewise, would my mom have to put her name and income on line 24b, even though she and my dad jointly filed and also fill out a I 864A. Under wages, salaries, tips, etc. on the transcript, it is their combined income listed.

My dad's individual income is more than enough to meet the co-sponsor requirements, so my mom's income is not needed, but I am not sure if he should include my mom's income because on the tax transcript (they have the long version), it does not really separate where the money is coming from.

You must submit income slips from your Father - this will show what his individual income is.

My opinion is that you enter the joint income on the I-864 - then a note saying see attached individual income slips for sponsor, or something to that effect.

"If a sponsor filed a joint tax return with a spouse, but is qualifying using only his/her own individual income, the sponsor must submit evidence of that individual income. This evidence would include, for example, the sponsors own W-2(s), Wage and Tax Statement, and if necessary to reach the income requirement, evidence of other income reported to IRS which can be attributed to him/her, usually on Forms 1099:. link

"For purposes of demonstrating means to maintain income, the determining income amount is the income, before deductions, on the sponsors income tax return. In other words, income means an individual's total income (adjusted gross income for those who file IRS Form 1040EZ) for purposes of the individual's U.S. Federal income tax liability, including a joint income tax return (e.g., line 22 on the 2005 IRS Form 1040, line 15 on the 2005 IRS Form 1040-A, or line 4 on the 2005 IRS Form 1040EZ or the corresponding line on any future revision of these IRS Forms)". Thanks, that helped quite a bit and it was quite interesting reading some of the information in the link. However, would line 23 still be just my dad's income or my dad's and mom's joint income? I think I will just have my mom fill out an I 864 to be safe.

Also, on my parent's joint tax return, there is about $6,000 in unemployment because my mom was briefly unemployed...my dad has had the same job for over ten years. Should I explain this?

If your dad is submitting an I-864 as a joint sponsor, his individual income should go on lines 23 and 24a. He is supposed to list his joint income on line 25, where it asks for the "total income" from the most recent tax return.

Hello!!

We have a joint sponsor which has 7 in Household including me ... His total income in 2009 is insufficient to complete what is required. I want to know if my husband's income would be counted to reach the requirement?
