filling out these forms and need clarification!

maybe i'm over-thinking some of these simple questions, but i sure could use some help to clarify a few things. any help is very much appreciated!

  • FORM I-130
  • question 15 & 16 - who's employment are they referring to? My husband who is the USC? Do they want his employment details? I'm not employed - we were recently married, but originally entered on F1 (I am still a student)
  • When the forms ask PLACE OF LAST ENTRY, do they mean POE (which would be Canada) or do they mean what US city/state did I enter (which would be Oklahoma)?
  • When I had entered, the officer made an error and stamped my passport with an M1 visa. Sevis called my school and I had to go to immigration to work this out. They ripped out my I-94 and replaced it with a new one. They wrote notes detailing the correction to an F1 visa. On the old I-94 there was a stamp showing a recent visit back to Canada. Now my passport only shows 1 stamp - my original date of entry as a student, into the US. Should I list the original date as my last date of entry? Or should I list the actual date (March, 2010) even tho it is not reflected in my passport...?
  • What is an A#? I know this is an Alien # but is it the same as my I-94 number? Or, how do I find my A#?
  • FORM I-765
  • question 16 - asks for the code in which I am eligible to file for my employment document. Well, I am filing it along with my I-485, and I am now married. Is the proper code C9? I am not a refugee, nor am I seeking asylum, I am not applying for school or employment related purposes either.

  • I'm not sure what to check off here? I'm not Cuban so none of those options apply to me. I'm Canadian, originally in the States on an F1 and now my husband :) and I are married...
  • What is a Non-Immigrant #?
  • How do I know which Consulate issued me my student visa?

The only numbers i can see on any of my documents include a 11 digit number (Admission #) on my I-94 and I also have a SEVIS number (student #)

08-24-10 Service request submitted for Biometrics Letter.. waiting, waiting...

09-01-10 2nd service request call put in - Dallas ASC backed up and everything is on hold! :(

09-03-10 Infopass appointment set for September 17th

09-03-10 EAD TOUCHED!!! I might not need my Infopass appt. after all!

09-07-10 Another touch for EAD

09-08-10 EAD TOUCH again! woo hoo!

09-17-10 InfoPas appt @9am. EAD APPROVED on Sept 2.. but still waiting for biometrics

09-20-10 3rd service request to USCIS, escalated to IO. still no bio appt

09-28-10 AP sent to Chicago Lockbox

09-29-10 4th service request to USCIS, useless convo with IO

09-30-10 AP received and signed by USCIS, J.Chyba

10-04-10 Another useless convo with IO

10-06-10 Letter sent to Congressman

10-10-10 Letter sent to Senator

10-11-10 AP Touch

10-13-10 Email received, AP approved :)

10-15-10 Useless SECOND Infopass appt. and useless AP without biometrics

10-16-10 I-512L AP Doc arrived in the mail

10-18-10 Another USELESS call to USCIS

10-19-10 Got my biometrics appt for Nov 3rd!!! early walk in complete 10-20 *SEE ABOUT ME PAGE FOR MORE TIMELINE INFO!*

Hi, Bullwinkle. As far as the employment questions are concerned, they are about you. You see, normally when someone files the I-130, is for a consular post, so one can assume the intending immigrant may be working at the time.

The point of entry would be Oklahoma in this case, as you entered the country there, unless you crossed the Canadian border PHYSICALLY into a POE, and then boarded a plane.

I am unsure how the mishap with your passport will be fixed, so I suggest you seek assistance with UCSIS or even CBP (dunno)... About the A#, I don't have one either, but I can tell you that it is NOT the I-94 number. :no:

Yes, your category for the I-765 is ©(9), good thinking!

Finally, you need to check that you qualify under section A, which is the AOS resulting from a family based visa petition, even though it is not approved yet (I assume you are filing with I-130 concurrently, because this is the only way to do this without a Notice of Approval).

    This is the USC's employment. The I-130 is the USC's petition and it is mostly about him. (I think HappyKnappy assumed you were the USC.)

    This to refers to where you were inspected. But you will probably want to include a note because your I-94 might reflect something else.

    I don't fully understand. Do you still have an I-94? If so, you answer should reflect the dates written on it. If not, your answer should reflect the latest entry stamped in your passport.

    I don't know if you get an A# as a student. If so, I don't know where you would find it. My husband had no A# and so I put 000000000 (however many). Actually the most recent versions of some of these will do this for you if you leave the space blank.

    Again, I forget this section and I don't want to mislead you, but it actually wasn't as confusing as I thought at first. I think you are probably overthinking this one. I know that's what I did at first.

    It would be the one in Canada that you sent your forms to or that sent you your forms or that you had to visit, but I really don't know about student visas and the process of getting one, so I'm really no help.
