In Deferred action and cant get ead..

Hi everyone i need some help.I have an approved i360 and was told i have to wait to file form i485 for adjustment of status due to my ex husband being a green card holder. I was placed in deferred action and filed for employment authorization i765on march 1st. It has been past the 90 day time line and my case hasnt been touched, so i made an info pass appointment.I was then told that i can not get employment authorization due to my ex being a green card holder. I was also told that when a visa number is available i will be able to file the form i485 and the i765 again.I havent received anything from vermont service center saying my case was denied or that i am not allowed to file. I thought that once a person was placed in deferred action they we able to file for employment authorisation.im i wrong and has something changed???

It is unclear what your timeline is.

You would need a visa number to adjust status, quite a wait for PR's.

I'm not sure I know I was placed in deferred action..and told to wait till I'm eligible to file. But if I can't waor how I'm I gonna be able to pay the fees when its time to file...I don't mind waiting because I can always renew or extend the deferred action. I just thought I would be able to work since that is the direction and explanation that's on the uscis website.........vawa is not an easy thing to go through so I figure they would allow us to work.

Timeline

I just wanted to let you know that I also have an approved I-360 based on marriage to a green card holder. After the petition is approved you qualify for work permit. My application was submitted few days after the approval and took around three months to be approved. Perhaps you can try to file again if you didn't do that yet. Or if your priority date is current just file the whole things. But as far as my knowledge and experience goes, you are qualified to obtain work permit if you were placed in deferred action.

5/5/2010 - I-360 Approved

AOS

11/15/2010 - I-485, I-765, I-131 filed

11/30/2010 - NOA received

12/13/2010 - Biometrics appointment letter received

12/23/2010 - Attended biometrics

1/3/2011 - Notice of I-485 transferred to NBC

1/29/2011 - Interview notice received for March 1st

2/7/2011 - EAD arrived

2/11/2011 - AP arrived

3/1/2011 - Attended interview

1/7/2012 - Received permanent resident card
