Immigration fraud on I-130

It is helpful because you have current & correct info about your situation. You now have answered the very questions that you asked & should feel you are making progress. You have the cops & ICE working to stop the abuse. You asked what to do next & you have done it. Next is your freedom from further abuse.

okay, well he isnt abusing me in that sense anymore since we are not living together but yeah he has been threatening and he is continuously contacting me via email and instant messaging that became the basis for his warrant too

i guess I'm just not exactly sure what will happen next...I really thought that once I got a divorce from him that would be the end of it...but I guess not. I also dont wanna be responsible for him financially.

ICE can be useful, but not with just one phone call.

When you call back to ICE, tell them that you are following up on withdrawing the I-130 petition (give the date of the letter)

and then ask to be transferred to a 'case officer'.

The first person you talk to at ICE only puts stuff in the computer, never, ever can 'get things done'.

When you get to the Case Officer, remind him/her that you've withdrawn the I-130, and tell the CO that you want to withdraw the affadavit of support. Tell the CO that you've filed for annulment back in the 'home country'.

then

tell the CO about the physical abuse and the protective order.

Don't waste time with the first person that answers the phone. Get a Case Officer.

re: police contacts - when you call back, mention to them about the protective order, and that you've withdrawn the I-130 petition, and remind them that there are ICE entities they must liason with when they pick him up. Call the police 'in that new city', as well, going over the abuse case , and remind the 'new police unit' that they will need to liason with an ICE staffer in 'that city' about this guy.

you should get recorder for your telephone, asap.

Record all phone calls, regardless if it is 'him' or no, for the next 3 weeks. Ya never know, a buddy of his might call in.

You don't have to tell anyone that you are recording - you are gathering up more evidence for the ICE Case Officer, instead.

well he doesnt call anymore...he's stupid enough to contact me via the internet where I can keep a record of written communication by him

Any type of contact is a form of abuse if you dont want it. Keep records of all of it to turn over to the police. Keep pressure on him until he decides he has had enough or is put in jail.

If there is a bench warrant out for him it wont be long. Once he's been put in jail for this it may be much easier to deport him. It certianly will make him easier to find.

what do you do if

if hubby comes into the USA on CR-1 status and starts beating u every day...then he confesses that he only married u to get status in the US...u guys separate just about to weeks after his arrival and he moves to another state... u contact immigration and tell them he was a fraud in writing,... ur hubby has not yet received even his conditional green card,...and u get your marriage annulled back home.... because of the annulment the guy becomes reactionary and starts harassing you over the phone and threatens you... finally, even though he was supposed to have been in another state he shows up at your doorstep...you now have no idea what his address is but you are able to acquire a TPO against him anyways and on top of it due to the fact that every time he harasses you, you file a police report the police have taken out a warrant for stalking against him. Now the thing is that you finally find out what his address is...what do you do next?

#1 Write everything down. You can still divorce even if he your find him to have him served. Its called a Constructive Divorce. No kids, and nothing over $50,000.00 purchased together, no property, etc. You can have the Divorce petition posted at the courthouse where you file for divoce, OR, do a Service by Publication which is have him "served" by posting Notice of divorce in a newspaper. Best to have notice posted in a paper where you know he was last at. I did this type of divorce myself, but its best to hire a attorney if your not familar with the courts or procedures of divorce. And Yes you can do this type of divorce even if he is not in USA.

#2 Contact I.C.E., also get a re-straining order against him, protect yourself, bank accounts, credit cards, and never go out alone, try not too.

#3 Keep all copies of letter to USCIS, I.C.E. or any other agency regarding him. And always get names of people you speak too.

no further luck with ICE i called them up again and gave them a detailed account when I asked to be transferred to a case officer she said this is just the tip line there is no such person here...I can just add information to the report that you made initially...then she told me to contact USCIS tomorrow instead

i have a rstraining order.... we never had joint bank accounts or credit cards...n i dont go out alone...but he's scaring the hell out of me

i did contact ICE but i think i hv to contact them again cuz i wasnt able to speak with a case officer
