So sorry to hear that pharmacist, as Lorelle says it is not a denial, keep you chin up, it's so hard for you we know that and we are all sending you prayers and good wishes

come to the Islambad pakistan thread. we all are on AP/AR there. we can offer support to you. all of use got the dreaded Blue paper 221g AP/AR. Black hole abyss..

AR/AP can last 17 days -2 years. to day I am the longest one on AP/AR.

I have been on it 11 1/2 months now. come there we can share tips and how to cope with this

and we can give you numbers on who to call. but, since you just got AP/AR you need to give it

90days before you can really do anything. in about 2 weeks you need to start calling DOS

department of state. when you call you can ask about updates on your case. here is the number.

have your spouses < immigrant > date of birth and also case number..

So sorry to hear this! I know how hard this is for you. Our petition was sent back to the U S after 8 months on AP and we are now waiting for our Notice of Intent to Deny letter. Like you I cried for a whole day. Then I got my second wind and found new strength to carry on this fight. I refuse to give in. Nothing about this process is easy, but dont lose hope. I pray that everything moves swiftly for you and that the road is much smoother from this point on.

hey guys , thanks for all the info.

and all the well wishes.

heres the issue they kept harping on- at his first interview when he came on his K-1, they never put a stamp in his passport. my husband is beginning to that this was done intentionally.

somehow his I-751 got approved. BEFORE HIS AOS WAS DENIED or APPROVED. they gave him a copy of his denied I-485 in november 2005. (could this be fabricated with a fake date on it?)

moreover he traveld twice..and was inspected upon return. before he was given a 2nd interview in november 2005. AND NO ONE KNEW HIS AOS WAS DENIED? dont tell me they didnt update the system. he was held up in a room while they verified his info...for 2 hours each time. we sat with him once.

i mean once ur I-485 is denied, dont they have to take measures to make u leave the country voluntarily or involuntarily? or at least NOT LET HIM GO BACK AND FORTH OUT OF THE US?

so I guess its no wonder why.....you guys can assume the rest

Hes beginning to think that there was a sincere effort by the USCIS to cover up something.....

221(g) in the blue sheet is not a DENIAL. It means, they need additional documents or they will do the security check. What did they say on the 221(g)? Is it Administrative Review? Don't worry, they will call him to pick his visa up as soon as they get the security clearance from Washington DC. It can take upto 2-10 weeks. Since you have a son together, I think, your clearance will be done soon. They usually do it for the male applicants.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

As I mentioned in the AOS forum to this situation, chances are because there is complications to your husbands case, it is very likely they will need an advisory opinion from washington before proceding. An advisory oppinion is on a point/s of immigration law. A conof on looking over the case would realistically not be able to determine if your husband was eligible for a visa. Even if you had a lawyer handling your case, I feel the result would of been the same. Just hang in there sweetie (F)

Yes, administrative review means to me, they review how they handled the case, obviously of what you say, they did or did not what they were supposed to do...I assume that at the completion of the case, they noticed that, the whole thing was not holding together in the proceedures they have operated...i.e. no stamp, etc...overall this has nothing to do with your hubby, it's an internal situation. The system is very complex, fascinating actually, so irregularities might happen and they have to do their job of verifications. You are at the end of all this...just a little more to wait. My thoughts are with you, hang on!

Note: were told the long delay due to huge backlog and internal changes in VT

04-June-07 - NVC generates DS-3032 & AOS bill

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

In USA:

hey everyone, thanks for all the wishes..

funny- my husband said they will send this for review..at least for themselves to find out what went on even if they dont let us know.

either way WE HAVE FILED A i-290 WITH THE BOARD OF IMMIGRATION APPEALS ON DECEMBER 19. 2005. right after he left.

i mean he lived and breathed immigration for the whole while that he was here- i guess he figured something like this would happen. before we even filed the i-130, we filed that appeal which btw takes a year for before we can ask them the status.

as far as evidence goes, he said the consular officer never even asked for any proof of our relationship.

we had 3 bank accounts, their respective voided checks, 6 credit cards, cable, utility, electricty, land line, cell phone, home mortgage stmts, our closing stmts, his florida driv. lic, vehicle registration, vehicle insurance, another i-864 package, 19 paystubs i collected, our health insurance card, our son's birth cert listing him as the father, family pics, wedding pics, egngmt pics, pics of us in our house, our house after hurricane wilma, a plaque given in both our names for a large donation..

but obviously none of this mattered..

anywho lets see.. he said he will compose some letters to send off to some congressmen or whatnot. not that its going to make adifference-
