Hi guys, I am hoping that somebody can tell me if CSPA should be applicable to my case.

My birthday is 12/26/1984. My father (LPR) filed the I130 petition for me before my 21st birthday. My priority date is 12/7/2005.

I received the approval letter this January. The notice date on the approval letter is 1/21/2010.

According to the January 2010 visa bulletin the priority date F2A is 1/1/2006 which means that my petition is already current by the time I received my approval notice.

However, the notice type on the approval notice said "Section: Unmarried child 21/order of permanent resident"

I filled in those dates into the CSPA calculator and it said that my petition was pending for 4 yrs, 1 mos, 14 days.

Under the F2A category, my petition should be current on 1/1/2010 which means I'm 25 years 0 months and 6 days old when the petition became current.

CSPA age is 20 yrs, 10 mos, 23 days

Is it a mistake on USCIS' part for bumping me down to F2B category or is my calculation wrong?

Have your dad contact the NVC and see what they say, when I asked they stated our son was under the CPSA his petition sat for 2 1/2 years only though. Hope you get the answers you need from the NVC

helu newbie...what date and year of your approval? CSPA was apply for me..i just got here last march 2010. jan 2005 was my priority date, then my petition got approved oct 2008.. you need to file for cspa whithin 1yr.

here's mine:

petition file: Jan 2005

approved: Oct 2008

date of birth: jan 1986

2005- 2008= 3yrs

priority date available:August of 2009, i was 23 yrs old at that time.

all you need to do is calculate

23-3= 20yrs old..so i was able to get my visa then..
