Hi. Does anyone know what can be a proof of an active duty military status?

We have recieved a mail from USCIS stating that they need a proof of my

husband (sponsor)'s active duty military status. Before we applied we have gone to speak to an immigration

officer and he told us LES(leave and earning statement) would do so we sent it as a proof but appearently it was NOT good enough.

I would appriciate if someone can help me with this!

make a copy of his militry ID Card, get a letter from his commanding officer, copy his current orders.. a lot of ways to prove he is active duty.

Why do you need it?

The financial requirement for Active Duty Military is 100% of the poverty guideline rather than 125%. Maybe that's why he needs to show it.

Also, appointments and processing can be put on hold while the military person is deployed.

Thank you guys very much.

USCIS needed it because we indicated on I864 that he is on active duty but we did not enclose the proof ( we only sent LES because we thought LES was good enough to be a proof)

He is currently TDY enroute to PCS and I am already here at his PCS location. I dont know if he has his commander yet to get a letter but I will see what we can do.

Weird...my husband is AD and we also put that on the I864...we just sent his W2's and LES and they haven't questioned it (no yet anyway). Then again they haven't exactly done anything on my AOS case....

Maybe it's only an issue when the advantages of being AD military are being applied. If your income is way over the guideline, it might not matter in the least.

They require a copy of the military ID for the I-864 if you are taking advantage of the 100% poverty level for active duty.

Just had our interview yesterday and they asked for both of our military ID's a copies again even though we had submitted copies with the I-864 and we more than beat the 125% level!

AOS

August 30, 2005 - AOS, , AP applications mailed to Chicago Lockbox

September 9, 2005 - NOA's for AOS, AP, (dated Sept. 1)

November 28, 2005 - AOS biometrics - refused EAD biometrics at the same time

December 5, 2005 - AP approved

December 7, 2005 - Infopass appointment for interim EAD

December 12, 2005 - Received EAD card

December 13, 2005 - Received AP

June 14, 2005 - Case Status Inquiry/Tracer

June 19, 2005 - Letter sent to congressman

AOS INTERVIEW SCHEDULED FOR AUGUST 8, 2006

AOS approved - August 8th, 2006 - hooray - done with USCIS for now!

GREENCARD RECEIVED - August 18, 2006

Thank you for good advice everyone!

He went to finance office yesterday to get a letter and it is on its way.

We will send copy of his ID, orders, and the letter from fiance.

I also called USCIS office to ask why I was getting that letter and they said whoever

looked my paperwork probably didnt know what LES was. They told me to send LES again explaing

what it is but you know what. I am sending all these military paper work now.

He is O-1 and we are way over the 125 % guideline thing too.

Kinda getting frustrated but oh well.

Also, the DoD has a website that can check on his military status with his name and SSN:

I work in for the Matrimonial (divorces) part of the state Judiciary and we take that as official proof of military service / lack thereof. In fact, that's the only proof of military/non-military we'll take from future ex-spouses anymore.
