Hi everyone. I'm a little confused so I apologize if this is a dumb question. My fiance and I were married two weeks ago. We just applied for Social Security (that's a whole nother story) and from browsing through the vj.com site I'm confused as to whether my new wife needs to file for both an AOS AND EAD or does she already have "EAD Status" since she's a K1 visa holder?

Also, her 90 days are set to expire in 1 month...do I have enough time for everything?

Thanks for any and all help,

John

You do not have to apply for both, however if she wants to work, she would need the EAD until the AOS gets processed, as she DOES NOT have EAD status.

Whether you apply for both is up to you.

Is she going to need to travel home in the next 6-8 months? If yes...get AP - If no...don't and save the money. She can always apply for emergency AP if there was an urgent need to return home.

Same applies to EAD....if she needs to work aplly for it. If she doesn't then wait on the green card.

John,

There's no such thing as "EAD status". There is 'EA status', and your wife's status is 'authorized' but that will end when the 90 days are up.
