Hi everyone. I'm a little confused so I apologize if this is a dumb question. My fiance and I were married two weeks ago. We just applied for Social Security (that's a whole nother story) and from browsing through the vj.com site I'm confused as to whether my new wife needs to file for both an AOS AND EAD or does she already have "EAD Status" since she's a K1 visa holder?

Also, her 90 days are set to expire in 1 month...do I have enough time for everything?

Ok, first of all, how is it that you managed to post this thread SIX TIMES? :lol:

Please contact the forum administrator and ask him to remove 5 of them...lol.

Secondly, if your fiancee came to the US as a K-1 visa holder, then yes she MUST file the AOS. The EAD is Employment Authorization Document...it's a 1 year card that allows her to work in the US for a year from date of issuance. She only needs to file for EAD if she wants to work. Don't forget the AP as well! The Advance Parole allows her to travel out of the US and return while she awaits her AOS interview and approval.

* The 90 day time frame you are referring to does not apply to your having to apply for AOS and such - it was simply that you had to get married within 90 days after she entered the USA. And you've done that :)

Thanks so much, Sharon for your insight. That helps a lot. Yes, sorry about the 6 or something time post...after I posted the message, the confirmation page never appeared so I hit refresh like 5 or 6 times and that's how it happened. I should have checked to see if posted the first time. Oh well. Thanks again,
