My income is 34,000 per year. (42k from all sources but i dont want to put in all that extra paperwork since 34k is enough to qualify) Now...i have only started getting this much since feb 2006. Prior to that i didnt work for 3 years or worked so little that i didnt have to file a tax return (if you make under 7k you dont have to file a return) So I have no tax returns for the last 3 years. All i have is a few paystubs. On top of that they dont take out taxes, they just let me deal with that at the end of they year. Will this cause me any problems? I thought they might think my paystubs are fake if there is no withholding.

I also have about 15,000 in stocks and a few thousand in the bank. Do any of you know if this will be enough for my fiancee to get approved for a visa?

Aug 15, 2006 Sent in updated I-129f

Aug 23, 2006 NOA1

Aug 25, 2006 They cashed my check

Nov 28, 2006 NOA2 approved

Dec 2, 2006 NOA2 recieved in mail

Dec 7, 2006 NVC sends letter saying it will be forwarded to manila in a week

Dec 12, 2006 I receive that letter from NVC

Mar 22, 2007 St. Lukes appointment

Mar 29, 2007 7:30am Interview

Mar 29, 2007 12pm APPROVED!!! PRAISE GOD!!!

April 10, 2007 Fiancee Arrived!!! WOO HOO!!!

June 26, 2007 Wedding

July 2, 2007 Medical for AOS

July 6, 2007 Sent in AOS (cutting it really close to the 90 days!)

July 8, 2007 USCIS receives i-485

July 16, 2007 NOA1

July 18, 2007 NOA biometrics

Aug 11, 2007 Biometrics appointment.

Oct 11, 2007 Interview

Oct 11, 2007 Green card Approved!!! Cant kick her out now!

Oct 18, 2007 Welcome letter saying Green card is on its way

Oct 22, 2007 2 year Green card arrived!!

You should be ok with the following:

1.) All the paystubs you can accumulate

2.) The offer letter from your employer stating your salary on "company letterhead" paper OR A letter of employment from your employer, with salary and self tax filing affirmation.

3.) A letter from you, perhaps explaining the preceding 3 years of unemployment and the subsequent exemption from tax filing.

The fact that you have nearly 6 months of solid employment should carry you through.

I'm basically in the same boat as you--slightly worse off. I just started a job two months ago that's going to make me about 28,000/year while I work at building up my own business. But prior to that, I didn't work at all for close to three years while I was doing dissertation research. There were no income tax returns during that time for me either. For that reason I'm planning on getting a co-sponsor. My understanding is that USCIS and company are going to want to see about three years worth of financial data...and I'm pretty danged certain that what I've got at the moment isn't going to be enough. Can your parents or another relative help you out?

January 2004: Met Laurent at the Bibliothèque nationale in Paris

February 2004: We became an actual couple

January 29th, 2006: I left France to return to the United States--AWFUL to say goodbye!

June 2006: Finally convinced Laurent that a K-1 visa would be more time-effective than trying to get an H-1

August 1st, 2006: The K-1 petition is finally in the mail and on its way to Nebraska...WooHoooo!! And yes, I remembered to attach the check! :-)

August 3rd, 2006: USPS online tracking shows that my petition (sent certified) was received at the NSC at 5:05am

August 14th, 2006: NOA1 received USPS!! (I-129F recv'd at CSC: 8/4; NOA date: 8/10; last touched: 8/11)

October 2nd, 2006: I MISTAKENLY thought we had an approval...False alarm...Back to waiting...

October 3rd, 2006: TOUCHED!!

October 4th, 2006: REALLY AND TRULY APPROVED!!! Email notification lists 10/3 as the NOA2 date.

Later that same day: TOUCHED...AGAIN! Hope that means I'm in a cozy box and moving to NVC this week...

October 10th, 2006: Received official NOA2 via snail mail.

October 19th, 2006: Case received at NVC!! AWESOME!!

October 20th, 2006: Case forwarded to Paris!! DHL says two shipments were headed that way. Must be in there somewhere...

October 27th, 2006: Received official receipt letter from NVC via USPS.

You will not need the I-134 until Embassy time.

With that said, I would surmise that you have tax returns with minimum income levels and so forth until now? The only trouble is, you cannot list a current employer on the I-129F and other forms.

This is going to be problematic. I suggest you find a job, any job, even if temporary, so you can be forthright in your filing. The proper income level will iron itself out, once you find a job within the field (and income level) that had you filing in the first place.

Another thing to consider is where you are filing, if Vermont, you may find yourself approved prior to actually finding the appropriate position, income wise. This can create a headache at the Embassy.

All situations vary, Embassy wait times for interview, processing times and so forth.

If you can provide more detail, perhaps the forum members can better advise you.

This is a personal decision. You need to balance your ability to get an income appropriate job before Embassy time, with the urgency of getting your SO here.

At this stage, it sounds like a gamble, but that can change, depending on the circumstances.

i am half -way thru our paperwork and just lost my job.,with no new job in the foreseeable future. any suggestions?

Listen, you really need to think ahead in these cases. I'm not trying to scare anyone, not in anyway. I'm just trying to help you down the road in avoiding a mess. Getting approved for the K-1 only allows you to enter the country for the purpose of marriage. After marriage you will need to file AOS which has much stricter guidelines and requires much more evidence. You don't want to waste an approval, come too early, and then get denied AOS, and have to leave the country. You might want to learn more about what AOS requires for income. You also may want to look into a sponsor.

Just making you aware of the big picture.

That is a good reality check Andy. :thumbs:

But they should also realize that if they meet the poverty guidelines, with respect to income, they will be ok.

As I mentioned, more detailed information would be helpful in any assessment.

A history of solid income, above the poverty line minimum, can excuse employment bumps in the road.

Without more details though, impossible to assess.

yeah! William I agree. I would like to point out that I don't know what you will need in your particular case. You need to figure that out by learning more and seeing what you have to show for income. If at this point you see that you won't qualify, look into a sponsor. I'm not saying that you surely need a sponsor.
