Hello!

My fiance and I are filling out form I-134 and we have two questions:

on part 7, "I own real estate valued at" Do we still need to fill this out even if mortgage is more than the house is worth and on the process of selling the house?

and

on part 9 "I have previously submitted affidavit of support for the following person(s)"

He submitted and affidavit of support 8 yrs ago for a previous marriage. Will this affect our application in any way? Does the income requirement increase because technically it is for two people ( I think I read somewhere that he is still resposible for ex-wife). And ex-wife now has a stable job and supports herself?

If the petitioner's income meets the guidelines you do not need to complete any information at all regarding bank accounts, home values or any other assets.

As Matt & Bing stated, you don't have to list any assets if the sponsor qualifies on income alone. Listing a home with an "under water" mortgage would not be wise under any circumstances, since they only consider the difference between the home's value and the mortgage value as an asset. A home with an upside down mortgage has no value as an asset - it's a liability.

The affidavit for the ex-wife will matter if it's still in force. It doesn't matter if his ex-wife is supporting herself. Unless she has become a US citizen, or has accumulated 40 quarters of Social Security work credits (10 years) then the affidavit is still in force, and he can be held liable for her support. The consulate may consider her in determining the household size.

And yes, ex is already a US citizen. Since she is we don't need to worry about that? (I still worry though because Ph is high fraud country and he has already filed previously) Super thanks for the replies! :D

While that I-134/I-864 is no longer in force if she is indeed a US Citizen, you still need to answer honestly that yes, he has filled out an I-134 previously. He might wish to attach a BRIEF cover letter mentioning the previous beneficiary is now a US Citizen if he knows it for a fact.
