Hi,

I hope someone can help me with my situation.

My I-751 was denied because i missed my biometric appointment.

I ended up filing I-290B for appeal.

The only problem is that currently i am in India and coming back to US in two weeks.

Does anybody know if i will have any trouble entering USA while my I-290B is pending.

Any feedback would be greatly appreciated.

NVC PROCESS

Aug 09, 2007 - NVC Received Package from CIS

Aug 20, 2007 - Generated DS 3032 and AOS Bill

Aug 21, 2007 - Emailed DS 3032 to NVC (Used James Shortcut)

Aug 22, 2007 - Sent AOS Bill overnight (Used James Shortcut)

Aug 28, 2007 - NVC Received AOS Bill (Automated Voice message)

October 15, 2007 - NVC Received AOS and DS-230 Forms

October 24, 2007 - CASE Complete

November 2, 2007 - Case at Embassy

January 10, 2008 - Interview Date

January 10, 2008 - VISA APPROVED

Not very sure about this one. Contact an immigration expert.

The denial of a 751 terminates your conditional residence and mostly produces an NTA to appear in court. You may still be in status because of the Motion filed, but its unknown what the CPB will do at the POE. The USCIS and the CBP act differently very often.

Can you stop by the US Embassy or Consulate nearest you? Perhaps they can give some sort of clarification, or reentry permit to allow you attend the hearing, or have it transferred to there. I would think there would be some sort of SOP in such a case.
