Hey guys,

Getting ready for our June 1 interview. I have not filed taxes for the past few years on the basis that I didn't make enough $. My grandfather is our joint sponsor. When we sent off all the financial supporting documents to the NVC the 2009 taxes were not yet due. The 2008 tax papers were submitted since that was the current tax year. This is what it says in the letter we received from the NVC:

"IF a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with proof of an IRS Federal Income Tax Extension in lieu of a Federal Income Tax Return, the applicant must bring the sponsor's most recent Federal Income Tax Return to the visa interview."

We did NOT provide the NVC with proof of a tax extension because it was not necessary...Do I need to bring 2009 tax returns??

NO i did not file an extension because I (the sponsor) did not make enough money to even file taxes...I have NOT filed taxes since 2006 because of this.

My grandfather filed for 2008 and 2009, and of course all the years before.

Even though the NVC forwarded the 2008 tax returns to the embassy (they will have these when we go to the interview and we will bring a copy) should I bring the 2009 tax returns which were not included in the I-864 packet sent to the NVC..the tax returns FROM my grandfather??

I'd call the embassy here too only they don't except calls and seem to have a problem replying to emails.

bring grandfather's TY 2009 stuff to the interview.

If you haven't done so, yet, write a letter of explanation about why you didn't file tax return, have it for interview day.

After interview day, you should file income tax returns, for those prior years - you might find nice surprise for refund.

Disregard this->> "IF a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with proof of an IRS Federal Income Tax Extension in lieu of a Federal Income Tax Return, the applicant must bring the sponsor's most recent Federal Income Tax Return to the visa interview." on you directly, but do bring Grandfather's TY 2009 stuff. yea i wrote a statement. i wasn't due anything and i didn't owe any thing...argentine salary. :D when i get back to the us i'll most likely file for 2010.

I never think to bring 2009 tax to my interview on June 2...i thought those just the copy of the 3 years like (2006,2007,2008) that we sent to NVC....this makes me worried my husband is out of town for his job and there's no way for him to sent it to me.....

When we interviewed last year in May they did ask for my husband's 2008 return even though we had also submitted the previous three years to NVC. Can your husband get a copy to you somehow?

When we interviewed last year in May they did ask for my husband's 2008 return even though we had also submitted the previous three years to NVC. Can your husband get a copy to you somehow?

yea, try and get a hold of him just in case. do you guys think my joint-sponsor needs to fill out the I-864 again or just forward me his tax returns?

We did not need a co-sponsor so I am not 10% sure but I would suspect they would want to see the updated financial information for the co-sponsor as well. Hopefully someone else will chime in. Good luck!

Ok great. TO CLARIFY: do i and my grandfather need to fill in new I-864 forms?? I'm worried they won't get to me in time through Fed Ex (or whatever company) before Monday. If we do need to fill in new forms for the Embassy would it be ok if he scans/faxes me his I-864 instead of sending it?? Reason being it's not "original"??? Thanks Darnell!!!

Ok...so your husband can call the IRS @ 800-829-1040 and request a transcript of his 2009 tax return.

If he will be next to a FAX machine when he calls....he can ask the operator to please FAX it immediately....which they are willing to do!

Then he can scan and email it to you.

This will be the quickest way!

A copy of his 2009 tax return transcript is admissible in place of the tax return.

My husband call to those people who did his tax refund so they sent the 1040 and summary of his 2007,2008 and 2009 to him and he emailed it to me, all the information about his tax refund are there.... Do you think this just ok to bring with me on my interview together with the 3 years transcript(2006,2007,and 2008) and the copy of our package that we sent to NVC....

If you do not have a copy of his 2009 IRS income tax return (1040, 1040A, 1040EZ...) or a transcript of his 2009 IRS tax return,

I would suggest getting a copy as outlined above.

It is a simple process and can be done wherever he is.

Emmamama, you do not need to complete new I-864 Affidavit of Support forms for the interview, as these were already done and submitted to the NVC prior to your interview date being set. Just bring the 2009 tax information mentioned above to the interview. Since you did not file taxes for the prior years, you may also want to bring copies of W-2's/1099's (or equivalent docs) to prove that your income was too low to file income tax returns, along with your written statement. One more thing, it may also be helpful to bring recent 2010 pay stubs for yourself and your grandfather (co-sponsor) to prove continuing income. These are not required, but it is better to have too much documentation with you at the interview, than having to wait additional time while more proof is collected, and then possibly having to come back for a second interview. I hope this helps.
