Here's what you don't know; when the sham weddings get a visa and as soon as the green card is issued they wait 3-6 months then file for divorce. This is public record and I am sure the consulate CO's are aware of these statistics so they deny more often than not. Think about it, for all of us who write and comment on this site we are not the ones doing fraud marriages, its the people who read posts but never comment and are not members only looking for info and looking for what problems they need to address. Look what has happened with adoption in Vietnam a few years ago, people taking money to do "paperwork" and literally buying kids to be adopted. Now the adoptions came to a halt. If Vietnam was not so full of fraud relationships there would be no need for all the denials except to cull the numbers of visas to issue. Their goal is for you to quit and then there's one less. Next time I go to Saigon I plan to wait outside the consulate one day they have interviews and count the blue sheets and compare to the pink sheets I bet its 10 blue for every 1 pink.

Been their and done that, I was there in the morning for my fiancee interview and everyone i saw came out with pinks. Most probably from the NON-immigrants side( students, works, and tourist visa). But went back later in the day and still saw more pinks, I only spotted 1 blue, and in the morning my fiancee only saw 1 blue given out to a young girl. She said window 7,8,9 were giving all pinks that moring... she nterviewed in window 11.

Round 1 (K-1)

Mar-16-09: interview (blue slip)

Mar-25-09: returned with blue slip denied, (white slip)

Jun-04-09: nvc received returned petition

Jun-08-09: nvc forwards to uscis

Jun-19-09: noa3 uscis received ( pending under review)

Sep-17-09 : touched!!!

Sep-21-09: Notice of Decesion, Expired free to file again

Round 2 (K-1)

(1st denied case received & forward dates at NVC,and 2nd refiling & noa1 at uscis are identical ....how ironic)

I-129F sent: Jun 04-09

noa1 recvd: Jun 08-09

noa2: Sep-17-09 APPROVED

noa2 Hard Copy: Sep 21-09 called CSC said not approved still pending in system (#######!!!!)

noa3 recvd: Nov 25-09 USCIS is reopening case NOA2 was issued in error.(Government Motion to Reopen)

RFE ( NOID) recvd: Dec 18-09 ask to give rebuttal on consulate finding regarding 1st petition

RFE sent: Dec 20-09 rebuttal submitted plus able to front load additional proof.

noa4 recvd: Dec 28-09 APPROVED FINALLY

NVC recvd: Jan 04-10

NVC left: Jan 12-10

Consulate Recvd: Feb 05-10

Packet 3 submitted: Feb 09-10

Packet 4 Recvd: April 16-10

Interview : May 12-10...PINK SLIP already on the table (2years 1week later)

Visa Pickup: May 28-10 In Hand!!

POE: May 29-2010 LAX

I said before more than once.. this was not intended to be about me.. and clearly said this was not a woe is me topic.... ease up man.. it aint about Texas either...

Like feeling Lucky noted.. from one day to the next they could see almost all blues coming out and then see almost all pinks another day.... do the quality or validity of applications really change that much from day to day? The CO does really matter as some are lesslikely to issue apink any day.

We all know about the fraud at the visa and the things that people do to sneak through... this is where the red flags come from that we all discuss....

We have seen so many reports of the arrests as well as the sentencing for those caught in the schemes... it sucks that they exist..

Wow Scott, you woke up at 5am this morning to post this? hahaah well, accept if you're in Vietnam. Anyway, It is how it is man. The frauds are the one will be most likely success at this process and we are struggling doing the same. Well, I guess we can't read the C.O mind can we? Just hope that they can find what they want and let us be together. Someone can get married 3 times and couple of those times are from Vietnam and still get her over here. We are on our first marriage and first petition and get stuck with a "sham relationship". It is just b.s of how they do their investigation (if any).

We wish you guys luck and hope for a positive outcome.

It's not so much 'woe is me', it's more like '#######'. You do get mad when people are approved ahead of you, but it isn't their fault. A lot of the angst people have is not necessarily directed at other filers, it's against the Consulate. Sure you can rant about the process to family or friends , but they don't know what your going though. People take out their frustration here. Where people can relate to what your going through. With a high denial rate at HCMC, you're going to get some pissedoff people. Don't take it personally.

26" redfish.. good.gif I thought back and I left around 8 so it must have been a time difference thing as I posted not long before I left.. The wind really kicked up on the way back... 2'chop ... yucko...

I'm actually not pissed at anyone... its a frustration with the system thing... As I said before, I cant imagine what Frank is feeling now... Chin up brothergood.gif .. as well as the others in AP and going through rebutals... A good friend of mine keeps saying.. "remember, you're dealing with the federal government not Fed Ex... Nothing happens fast and nothing ever makes sense..."

I wish we had those nextel guys from the commercial doing these cases for us...

My chin is up brother. I am married to the love of my life and thats a fact no one can take away. The US reconizes my marraige, the VN gov does too and so does the IRS. I undersatnd why were in AP. I need to get the CO to see past what put us there. If we did something different from the cultural norm it doest make us wrong, just looked at closer and Im fine with that. I guess if we had to do it all over again we would have taken more time, but it is what it is. I have and will continue to supply evidence to prove our case.

Scott I do feel bad you've been taking a whoopin here, honestly I dont read your posts as some here do. I find yor insight interesting and you are always keeping the conversation positive and moving along.

I must admit that it is quite disheartening to see folks getting visas, that sent in thier initial packet to USCIS after we had our interview.... I am not saying that I am not happy for them.... I would not want anyone to have to endure a long wait for this process to come to an end... the issue is that there is such a huge disparity between not only one case and another, but the disparity between one consulate and another...

wow its amazing that a visa can be granted in as little as 3 months from NOA1.... as we approach a year since NOA1.... and there are so many others that have been waiting several years.... blink.gif

what a messed up system this is....

I think these statments are why people think this topic is about you, and that you are "crying about it" Such statements could lead anyone to think that way. It is sad to say that this is what I might have to go up against in the next comming months, as I am planning on filing next week. Any suggestions on how to help her deal with the stress? Any suggestions on how I can deal with the stress?
