I haven't read all the responses, but there is NO rule about this. It will depend mostly on your proof of strong ties to your country.

My husband came several times on two different tourist visas that he got AFTER we were married. Each time I wrote a letter for him to bring to the interview.

The first time, I (the USC) was living and working abroad. The second time, our daughter and I were already here in the US and we definitely planned to start the IR-1 once he arrived on the visit. I wrote that in the letter. We did NOT plan to AOS, but things changed once he got here. I called the embassy before we started the AOS and I spoke to someone who said my letter was not pertinent.

My husband's ties to his country are probably strong enough for any CO anywhere to give him the B2. However, I do believe the COs in his country are in tune with the culture and can recognize ties that are impossible to document. They don't have many applicants and it's the sort of post where people without years of experience are probably sent to pay their dues, so they aren't as cynical.

The point is, it probably also depends a lot on the CO.

AOS Timeline

4/14/10 - Packet received at Chicago Lockbox at 9:22 AM (Day 1)

4/24/10 - Received hardcopy NOAs (Day 10)

5/14/10 - Biometrics taken. (Day 31)

5/29/10 - Interview letter received 6/30 at 10:30 (Day 46)

6/30/10 - Interview: 10:30 (Day 77) APPROVED!!!

6/30/10 - EAD received in the mail

7/19/10 - GC in hand! (Day 96) .

I've never heard of this. More importantly, how will they KNOW that I'm suddenly married to a USC? That seems a bit silly to me but stranger things have happened. If you have a link to prove it i'd be interested to read it.

OP - no issue going in on the VWP that i know of. Or applying for a visitors visa. You will need to show strong ties to your home country of course. Best of luck :)

They will know it magically - coz you have to dosclose it on the form. If you do not do it that could be considered a concealing information.

You can have a B2 when you married to USC - most post will issue u one, the problem is at POE. Thats where you will get stopped and most like put on the plane back home unless you really have a strong case to be in US on temp basis while your immigration application is in process.

Oh I hate to thread hijaak, even hate, more, to respond to a thread hijaak -

but.

IF you have USA residency requirements for 5 years , the child might automatically qualify to have 'Consulate Record of Birth Abroad', resulting in DOCUMENTED US Citizenship and a US Passport. Check the US Embassy website for Ciudad (sp?) de Juarez, see if you qualify.

Darnell - how does that qualify , she is USC and she has been living n Mexico not the other way around where her husband and children living in US.

She can qualify for Mexican citizenship.........lol j/k
