My wife just called me, she picked up the tax returns for 2004 and 2005 from the accountant. After rereading the yellow rfe we were sent, it states that they need the most recent federal tax returns which we have now and also a w-2 form. What is a w-2 form.I told my wife and she said she didnt have one as we only returned from ireland in march of this year. She can get it in her job but it will state she paid no tax last year as she only started her job in late march. Is it needed as we dont want to take a chance as we waitied 7 weeks for this rfe.

The tax returns for last year are fine and should satisfy USCIS as it states my wife earned $50+k after tax.

A w-2 is the form given to you from your US employer that tells you how much you earned and how much you paid in taxes for that taxation year. If you just returned from Ireland, then no, she wouldn't have a w-2 since she did not have an American employer. Try including the proof of income forms she would have received from Ireland and would have been used to support her world income when she filed the 2005 income taxes. I don't know if it will be accepted, but I can't see why not. Good luck.

I dont want to take a chance so i have to ring mis information line again. In ireland the equivilent to a w-2 is a form called a p60. They wouldnt accept that would they?

Yes they will accept a P60 I sent my P60 from the UK for last years tax to prove what I had earned and paid tax on as I was still employed for 2 months after I got here...

It was accepted with no problems..

I also submitted my P60 which I (USC) received while working in the UK and I had no problems either.

I think we may have a problem. I think my wife lost her p60 during the move over here from ireland.

only thing you can do then is contact her last employer and ask for a duplicte....

I have looked everywhere and i found mine for 2005 but not my wifes. This could add weeks as my wifes last employer in dublin are not the best admin wise. She worked for the healthboard.

Thanx kezzie.I am ringing mis infomation line and going to ask to speak to an immigration officer.

I called USCIS service center and i explained that we didnt have a w-2 as my wife worked in ireland last year. He said just to send the tax returns and explain why you dont have the w-2 as she worked in ireland. I dont know if i should believe him as i have called in the past and was given incorrect infomation. We cannot afford for any more delays.
