Can someone point me to information about stipulations, if any, on a marriage-based Green Card. As much as I hate to say it, I think my wife is being dishonest in our relationship and I truly don't believe out marriage is going to make it. If I lay out an ultimatum, I need written proof that our her status here may still be revoked and she can be deported if she was deceiving about her intentions of immigrating to the US for the purpose of marrying.

10/26/06 - Recv'd NOA1

11/9/06 - Case transferred from Chicago to Calif Servc Ctr

11/14/06 - Touched

11/15/06 - Touched

11/16/06 - Touched

11/17/06 - Touched

11/18/06 - Touched/Pending

11/20/06 - NOA recv'd stating that on 11/13/06 my case was transferred to CSC

01/25/07 - Recv'd email advising my case was sent to another office for processing???

01/28/07 - Touched (Sunday?)

02/09/07 - I-129f is now pending at the office to which it was transferred

02/09/07 - NOA2 from CSC

02/12/07 - Touched

02/13/07 - Assigned MNL#

02/21/07 - Arrived US Embassy in Manila

05/17/07 - Interview scheduled!!! Yipee!!!

06/22/07 - K3 Visa received

09/02/07 - Arrived in USA!!!

Don't do it...

Deal with the marriage on its own without regard to the fact that she immigrated via the marriage.

If you haven't completed AOS then don't do it, she'll have 30 days to leave as her K-3 will be invalidated.

If you've completed AOS and she has the 2 year conditional greencard she can file for ROC without you if you divorce.

If you've completed AOS and she has the 10 year greencard she has nothing to worry about.

Regardless, if you hold her status over her head to get what you want it could lead to complaint/charges of mental abuse.

If you are threatening to turn her in to ICE saying she entered the marriage for immigration purposes only then you need very compelling proof.

Just deal with the marriage and move on.

I don't WANT to hold anything over her head. I just feel she has been dishonest and :( as I've been used to obtain legal status here in the US.

I beleive in Karma, what goes around comes around, don't hold any grudges in your heart, if that's the case just get the marriage over with and move, life is too short to be waste on revenge, payback and negativity.

if divorce is necessary, let her stay in america, however if she wants to walk away with your money (if you have any), get serious. for me, it is one thing to use me to get to america, but another to try to walk away with more than you came with.

I agree with Bob4Anna but I will also add - if you have PROOF of her lying and deceitfulness then contact ICE (details at the bottom of the page) and present them with the evidence. If you have no evidence then there's nothing they can do but if it makes you feel better to call and talk to them about it, do so.

Above all else, divorce her if you don't trust her. It's honestly that simple. I know it makes you angry to think you've been used for a greencard but a lot of people have. By sounds of it you're at least one of the lucky one's that hasn't been used to get in the VAWA way (claiming you abused her) so divorce her now before she gets that chance.

Also, I'm not sure what effect you think showing she'll be deported will have on her. She'll either try harder to convince you it's real, she'll get upset and try to claim abuse, or lots of other things can go wrong. ONLY with proof can anything really happen in regards to her being deported (if you've already AOS'd that is).

That's an excellent question !!

IMO - the best answer sits at ICE - suggest you call them, inquire directly - number below, at the bottom of this page, in small print.
