Timeline

I filed the I-130 (petition for alien relative) for my husband. However, I don't work and therefore have no income.

I think my husband is allowed to file the I-864A, correct?

Well, if so, my husband started this job a few months ago and has no recent tax return forms. He just graduated from college May 2009 and has no income from previous years. He makes 640 a week and we are a household of 3. Does his income meet above the poverty guidelines?

If so, how do we prove that he makes enough income if he has no tax return forms?

You will have to write a statement of why you have no tax returns. Your reason is that you are not employed and earn no wages so are not required to file. I'm assuming your husband is on some kind of visa that allows him to work? His reason is that he was a full time student and earned no wages in 2007, 2008 and 2009 or whatever his case may be.

You can show income by getting a letter from his employer on company letterhead stating his yearly salary, how long he's worked there, whether it is full time or part time and if it is a permanent position. He can also submit photocopies of his pay stubs...maybe all of them since he hasn't been employed long. You can provide photocopies of bank statements that show regualar deposits of his paychecks.

His income is $640 x 52 weeks in a year. The guidelines are here I-864P.
