Please Help!!!!

Hi! I'm a K1 visa holder.Me and my fiance got married last May 1. And we are already applying for my change of status. My question is, I have a 3 year old son included on the petition and he was left in the Philippines. We can't get him yet then because we decided it would be better for me to get adjusted here before my son comes. We planned on getting him by December though, because my visa was approved last February and we were told that it is better to get him within one year from the approval date of my visa. What should we do now? Do we need to file the I-130 or is he still covered by the K2 status? Please help I need to see my baby asap :(

Follow to join is valid for up to one year from the date the K-1 was issued.... If beyond the one year then and only then is an I-130 is needed...

If you want to exercise the follow-to-join then contact the USEM to start the K-2 issuance process

Hello! Glad you made it to here too. Well About Your Son Visa, He is still in K2 Visa like my son,What you Decide is Right, Now that you are here, that will be easy for you to have your Son be with you soon, You said that he is included in your Petition,So It means his Visa also is on At works,But Unless your Husband give All supporting Document for him , Especially the Affidavit of Support, not the one he made for you,but same Affidavit but this time ,is his name,and He might need Someone to be with here,because his Age is not allowed to travel alone.Just follow up his Case and all things will be Alright.Did you ever tell the Officer who interviewed you that you want your son to be with this December? i f that so, All you have to do is follow his Case In PHILIPPINE US CONSULATE.
