my husband received his 10 year green card on friday. no approval letter or email/sms notification. just the card. almost done!!!! n-400 on 29 October!

ROC Timeline

18 NOV 2010 Sent 1.8lb packet to USCIS in Laguna Niguel (day 1)

19 NOV 2010 Package signed for V SEMEGI (day 2)

24 NOV 2010 Package returned because USC didn't sign petition (day 6)

calendar reset

26 NOV 2010 Package sent out again (day 1)

29 NOV 2010 Package signed for by V SEMEGI (day 3)

29 NOV 2010 NOA1 issued (day 3)

03 DEC 2010 Hardcopy of NOA received (day 7)

07 JAN 2011 Successful walk in biometrics (day 42) original date 1 FEB

01 MAR 2011 Date on Approval notice (although it arrived after the card did) (day 94)

About Thai Fiance(e)s or Spouses Employed in Thailand in 2010.

Does anyone with a spouse or fiance(e) that was employed in Thailand last year know when the Thai Government requires wage and income statements to be delivered to the Thai employee? What date are income tax filings required by the Thai government?

If you are worried about US taxes, I was told that we don't have to claim Teaw's income on my US taxes.

Basically that is correct in concept but not in execution. I do not want to start a feud in here but in order to file as Married filing Jointly, you MUST file on your worldwide income. The first step is to add a handwritten letter signed by both USC and foreign spouse stating you will file as Married filing jointly. You cannot e-file because of the requirement for this handwritten declaration. You would include the foreign spouse's income on Form 2555 and take your one time exclusion of foreign income up to $91,500.

But that is the easy part.

If you live in a state with income taxes like California, they do not allow you to do this. I have to file one form which is California resident for me and one form which is California NR or non-resident for my spouse. This requires the additional calculation of two different federal forms not filed, simply calculated so the proper figures can be transferred to the California state forms.

We have our AOS Green Card interview April 7 and I have not put Audy's name on the Deed, the bank has not allowed us to put her name on any of my bank accounts, and I cannot have a CPA do my taxes until we get Audy's wage and income statement which she does not know when it will come.

I am concerned at this point.

Why has the bank not allowed you to add her to your accounts? All she needs is a SSN/ITN, and she can be added there is no stipulation that she needs to have filed income taxes. Adding her to your deed should be the same.

You should be able to file taxes without the Wage & Income statement. I have done this before for, when I did not receive a 1099. If your CPA doesn't know this, you should get a new one.

The law doesn't REQUIRE that you do this. It is just one kind of evidence. We have a prenuptual agreement that states that we will keep our accounts separate. My wife owns a house and I'm not on that deed either, FYI.

The bank has not allowed me to add my wife to my bank accounts because she only has one ID in her married name, her SSN card. Her passport and credit card are in her maiden name. The bank requires one government issued photo ID in her married name which she doesn't have.

The taxes could be done but I do not want to go to the CPA without numbers for foreign income earned and foreign taxes paid. Yes we could just make up some numbers for now and file but I do not think that is the correct way to handle the situation. Yes my CPA is aware you do not need to have the foreign wage statement, but the numbers entered need to be accurate.

My CPA is quite fine. Thank you for you opinion.

Do documents in thai need to be translated and if they do they need to be certified translations? Looking at packet 3 it seems like they do not need to be but I want to make sure. Thanks.

11-04-2011 sent AOS to Chicago lockbox

11-07-2011 delivered

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

The documents should be certified translations to avoid any questions that they are correct.

As for the bank, Wachovia gave us no trouble adding Teaw but the state emp. credit union required a govt. ID to put her on the account with her married name.

Interesting. I will ask my acct. about it. We are on the way to Thailand saturday.

Don't worry about it Tom. I am just obsessive compulsive about following the tax code.

Right now I have no desire to think about any long hauls to Thailand. Audy and I are discussing a simple honeymoon in Hawaii.

You and Teaw have a great trip. I know she will be thrilled to see her family.

Yes, she is excited to be going back. Wanted to stay longer but we did not know if she would have her green card before we left and I didn't want any problems if she was alone. Maybe next time I will send her over two weeks

before me and then go over for two weeks. We have a lot on our plate with her friends from Western Digital and a cousin's wedding the day before we have our wedding party for the family in Buriram. I just hope the time doesn't go too fast because I will not be anxious to come back and go to work!!! HAHAHA!!!

Hard to believe, but after we got in today Teaw and I were walking through Siam to MBK and there was a table set up full of boxes of Krispy Kreme donuts with many in plastic covers on display. I sure don't know where they got them from but they looked like the real deal. I had to get a picture of it too!!

Yep, they opened a regular KK shop in Siam about a year ago. It always has a line out the door.
