Hi Monica,

It must be frustrating!

Have you given any thought to sending a reply email back to them saying something along the lines of -----

thank you very much for your response. We are happy to provide you with any further information or documentation if any is needed for the officer to make a decision. My daughter and I end our stay in Morocco on ______, and it would be greatly beneficial if we know the outcome of the consulate's decision prior to leaving. Again, we would be more than happy to provide you with any documentation, etc..... blah, blah, blah. Thank you so much for your time and attention, etc, etc, etc.

It may not get you anywhere, but you're offering to provide them with anything to help them make a decision, etc.

(I'll look at your timeline again to see when you're heading home!). I really hope you hear something before you head back.

they seriously asked your fiance what your stance is on iraq?! that is amazing!

I was shocked by that at first also, but after I started thinking about it...it makes sense...he is planning on applying for a teaching position with the Dept of Defense....makes sense that they would wonder what kind of views he has on the US soldiers and what they are doing since he would be working with them, etc. They don't miss anything!!

ok...well, we are leaving to head back to good ol USA in 6 days, so Hicham has been asking me what we will do if they call this week and say that evil D word :angry: "denied" ...i don't wanna think about it, but i just wanna be prepared. What r the options? I know we can get married here & file K3...what is the CR-1 i've seen?? Also, i think i've seen ppl refile the K1...does that ever work in Casa? What r the pros & cons of either (marry vs K1 again)? I'm hoping i don't have to think beyond this post about it, but i know if i'm not prepared for it I'll need the info & if i know it...MAYBE i won't need it :D Thanks in advance to any pointers...I'm so glad to have u all to bounce ideas off of. Btw, still no reply to the reply I sent them reminding them of our leaving, etc. Ok...out for now...hope everybody has a good week & we start to hear some APPROVEDs!!!

Monica, I hope you won't need this information and that you do get the approval but just in case, these are good questions to be asking. First, what can happen with a fiance visa that is sent back is that they kind of sit on it until it expires. I believe that is 4 months after the NOA2 date, although others can correct that if that is wrong. I remember reading it in the pinned thread about petitions being sent back. If that happens you definitely want to spend the time reading through that thread and talking to other members here who have gone through that process.

If you decide to get married then you would file an I-130 for a CR1 visa, as the K3 is no longer used. The CR1 is better anyway because it would allow Hicham to work pretty quickly after he got here and you wouldn't have to go through the adjustment of status process. He would get a 2 year green card and then you'd have to file to have the conditions removed after 2 years. That would give the 10 year green card at that point. It takes slightly longer than the K1 took you though because there is some extra time at the NVC. But it's not so bad if you are prepared. Some people have been able to whip through in days and there are lots of shortcuts you can find here on VJ. You can check my timeline and others. I think mine is similar to how long it takes, except that we stalled on purpose at the NVC stage so that we would get the interview during my summer vacation so I can be there. We could have had our interview by now if we had not done so. We filed the I-130 at the end of October, finished NVC at the end of April, and my husband's interview is in 3 weeks.

Basically you have two options...try the K1 again (but why would you get a different outcome?) or get married in Morocco and file the CR1. Well, you could also move to Morocco, so you have three options. Best of luck and I hope it comes out in your favor!

I believe Sarah was telling me about your up coming interview...would be crazy if theirs ended up being the same day :) She sat with me during mine & was a lifesaver...really helps having a distraction. And thank u for all of the info....I like to hope for the best, plan for the worst...Hicham keeps saying that he is sure they will contact him this week, so we will see...I REALLY hope so. The idea of having to change everything again, and try to get married here is mind boggling :wacko: I just wanna get back home & start life again together as a family. I really don't think my daughter understands that he won't be coming with us, and we don't know when he will be able to. Maybe that would do the trick...I will take my 4 yr old to the embassy & have THEM tell her that Hicham can't come with us....She's already going around saying he will be her daddy after we get married....ok, gotta get my mind back to positive :) Everything will be good....everything will be good...everything will be good...ok...much better now :) INSHALLAH i will be able to update soon with some POSITIVE info....needless to say we need some positive energy from Casa!!

Have you tried calling or emailing them again?

Emailed the reply last week...figured I'd wait & see if they replied today...I have been sending case status check emails every monday since the interview & have been getting quick replies. Will call tomorrow during the 3-4pm window if we don't hear anything before that time. I think calling seems to get results quicker. I'll update tomorrow after I call. Thanks for all the support!!

Ok...i know i'm thinking waaay too much about something that hasn't happened yet, but i just wanna be prepared....especially since we leave in 5 days & i'm afraid they will call on day 6 and say denied :( So...question is...if we get married in Morocco can I change my name in the US before he gets there? How does that work? I think I have all of the required papers needed for us to get married here, so i think we will be fine there. I was REALLY hoping to not have to worry about all this the last days we are here. But if they make the call this week I wanna know what the next steps should be...i can change our flights if needed...would REALLY like to NOT have to...would be nice to save some money, but...we do what we have to do. And any pointers anyone has on getting married in Morocco would be GREATLY appreciated. As u can probably tell...I'm a planner...I like to be prepared for whatever may come, so any info on anything that might come...LOL Thanks everyone for sticking with me...I know i'm probably freaking out prematurely, but with the departure date getting nearer, the worry is getting stronger. So thanks again...and I will let everyone know what happens with the phone call to the embassy tomorrow.

You won't get married if you're still waiting to hear about the K1, right? If you get married and then next week or in two weeks, etc, they approve the visa for the K1, you've made yourselves ineligible for it b/c you're married.

Are you guys in Casa? Sorry, I can't remember.

It was my experience getting married there that the more you have your ducks in a row the better - multiple copies of all the paperwork you need, well organized so you can pull it out at whatever office/court building you may be in. Patience, humility, more patience all are important qualities for the process. Money to pay people off for expedited processing is also another very important factor in the process. If/when they ask you about about pre-marital sexual relations, understand that if you say you have engaged in pre-marital sex, it will be more red tape, more questions and possibly a physical exam to prove you are not pregnant, etc.

There's a lot of running around from building to building to building; I think it'd be tough on your daughter, and could slow you guys down if you had to have her with you. If you have someone to babysit her, I'd recommend that.

Above all, I wouldn't get married if they haven't denied the K1 yet. Have you had an immigration casework from your senator's office inquire to the consulate about the status of your case?

I wasn't planning on getting married without a firm denial from the embassy...i just want to know just in case :) And i haven't contacted my senator's office yet...don't they have to have an original signature to do anything?? I forgot to contact them before leaving...we head home on Sat, so if we haven't heard from them by the time i get home I will go and get all of the releases done so my senator can contact them. And should it be the congressman or the senator?? i'm not sure about all of the differences with all of that...so which is the best way to go?? Thanks again!!

She said: "Your fiance's case is in Administrative Review"

I said: "So he is in Administrative Processing?" (I didn't know if there was a difference...better be safe then sorry...lol)

She said: "Yes"

Hey Monica!

When we applied 2 yrs ago for the K1 for Ramzey, he was put into Admin Processing for weeks until his 2nd interview... we don't know what they were doing at that time. His officer was a mean old lady. They finally called for the 2nd interview, all the while having him under the impression he was approved, and asked him a couple more questions, upon which she told him she "didn't feel" the relationship was real, and therefor denied the visa. So, we are getting married in January, then applying for the CR1(?). I plan to take 4-5 weeks off to go there for this as the running around can take up so much time.... I hope the AP in your case is going more smoothly than in mine, though. I know we did not have the proper evidence, in hindsight, to support Ramzey's side of the relationship as he is not much of a writer (so we were short emails)...

I have been following your threads, and it sounds like you have had your ducks in a row. Inshallah, you will have good news soon!

Thank u Bethany. From the sounds of the emails & what the CO said in the interview; i believe the CO was reviewing the evidence we submitted (nearly 300 pgs of conversations) and HOPEFULLY decided to approve him & now put him in AP, because they first emails said the CO was reviewing our case...and now they say its in AP. I just really want that call before we leave for him to bring in his passport...Btw, when they call to bring in the passport, that means approval right? And do they get the visa same day or how long between?? Thanks again everybody!! I think we r getting closer...INSHALLAH

Yes, Monica, if they call for the passport, 99% of the time it's because it has been approved. He should be able to pick it up the following morning at the window during the specified times. I hope you get an answer before you leave for home, but by the way Casa works...lol Who knows? If they took papers to look at, though, there will more than likely be another interview. Remember, their purpose is not to unite loved ones but to keep the "bad" apples out... *sigh*

06/26/2013 Requested supervisor review by e-mail & verbal request for birth document (fingers crossed)

06/27/2013 AOS accepted

06/28/2013 Checklist response sent for corrected DS-230 (I had my husband sign extra's just in-case)

08/02/2013 NVC requested a supervisor review on the checklist item over 20 business day window

08/05/2013 Case Complete!!! kicking.gif

08/27/2013 Interview Assigned

10/30/2013 Interview

11/04/2013 Pick up Passport

11/12/2013 POE @ JFK
