Does anyone know if I can include the child support I receive as part of my income for the i-134?

Would love to know the answer to that as well. I also some questions.. :unsure:

I didn't include the child support on my 2009 tax return because I wasn't getting regular payments until 2010, and couldn't really determine how much I was actually paid. Does the I-134 only want last years info when determining your annual income? Or do they want current information? If current is the case, then I would include my child support if possible. Even though I am above the 125% level without it, it would be nice to have the additional amount on there. Also, if I have joint custody, but my child lives with me with 90% of the time, do I say on question 8 that he is partially dependent on me since I get child support?

Yes, document it with a copy of the court order and verification that it is actually being received.

Child support is not taxable to the recipient and would not be added to income on your tax forms. Similarly child support payments are NOT tax deductible to the payor and cannot be deducted from income.

Alimony or spousal support payments if structured as a regular ongoing payment can be deducted by the payor and must be claimed by the payee. A lump sum payment as in a settlement is not a tax event.

I was curious about this also - does the child support count as income of the parent or income of the child? I've heard conflicting stories from other sources on that one.

I just ask out of curiosity, I didn't bother declaring child support on the I-864, because my income met the requirements without it, and I didn't want to bother searching my files for the court order.

That is correct.

In this context, it counts as income to the parent but in your case wasn't needed, so no issue.
