I 751 not submitted but needs to travel

I have a dilemma. My greencard expires in the middle of August. My 90 day period started last friday & i haven't submitted my I751. Documents & evidences are ready to be mailed out but I'm afraid I may miss biometric appt. I will be traveling abroad on June 17-July 4th. Do you think it will be a problem at the airport when I come in if I haven't applied for my I751 yet? I was thinking it may be better to just do it after I come back. Some say that I need the receipt from USCIS with 1 yr extension prior to any travel. Please help!! Thank you.

Hi and welcome to VJ!

You can apply after you return since your GC is still valid. Actually, in my opinion, I recommend doing it this way. However, be prepared and have the package put together and completed so when you return you can just drop it in the mail.

Just adding a simple note - this is exactly what I did when I was ready to apply for ROC. I planned a trip with my wife and when I returned (I had a month left in the 90 day window) I dropped the package in the mail.... check my time line for I-751, I mailed my package on the 21st of October, and my GC expires 11/19....

As long as your greencard is valid at the time when you re-enter, you should be fine. But make sure you send the I-751 package on time so that it REACHES them before your GC expires.

ohhhh thank you both so much! V333k, I was thinking of doing exactly what you did. I spoke to someone at the law office & they told me i should NOT travel without 1 yr extension receipt from USCIS. He also said they may likely question & may not let me back into the US. I told him that my greencard is still valid for more than a month from the day I come back. So I didn't think it would be a problem. He scared me probably because he wants me to use his service. I can't afford a lawyer fee right now :(

v333k, did they ask you any questions when you were re-entered US? I was thinking maybe I should at least send it in a week before I leave. I heard their system will update (at the airport) automatically? If it shows that it was extended, or submitted, would that be better than none at all?

LOL :rofl: I wat thinking the same. How in the world does he tell someone with a valid un-expired geen card not to travel? SMH.

Either way, I just sent mine on June1st, delivered & signed on June 7th. They haven't deposited the check yet. I hope i'll get the receipt before i leave the country on june 16th.

It seems CSC has been slow in sending biometrics out lately eventhough it largely depends on your local office's work load. They typically send biometrics within 3 weeks of sending NOA1. If you get your NOA say next week, you will still be in shape to travel and not miss your bio appointment since it will be dated a few weeks from the notice date putting the date beyond your arrival back in the U.S.
